With Charles Woodson

Charles Woodson is an 18year NFL veteran, former NFL Defensive MVP and Heisman Trophy winner. He is a Super Bowl champion, nine-time Pro Bowl defensive back and was inducted into the Pro Football Hall of Fame in 2021.

A champion both on and off the field, Charles has also formed the Charles Woodson foundation, providing scholarships to incoming students at the University of Michigan in need of financial aid. Additionally, Charles has pledged over $2 million to the University of Michigan C.S. Mott Children’s Hospital and established the Charles Woodson Clinical Research Initiative to support critical research projects that show promise of significant improvements in kids’ quality of life and longevity.

Woodson is also an oenophile who developed an interest in wine while playing football for the first time in Oakland, near the Napa Valley. He partnered with O’Neill Vintners to develop a signature wine label, “Charles Woodson’s Intercept.”

TWO-THIRDS BELIEVE HOMEOWNERS, RENTERS COVERS FLOOD DAMAGE

Despite news reports and public policy discussions about climate change and increasing catastrophes, including floods, 59% of U.S. adults say they are not likely to reevaluate their need for flood insurance, according to a survey commissioned by Selective and conducted by The Harris Poll.

Of the U.S. adults surveyed, only 14% had flood insurance. Among those with a standalone flood policy, 66% had filed a claim, which is an indicator of the prevalence of floods, Selective pointed out in its press release.

Meanwhile, the misnomer that homeowners and renters policies cover flood damage continues. Twothirds of consumers with homeowners and renters insurance incorrectly believe their current policy covers flood-related damage to home structure or contents, the survey found.

“Flooding is the most common natural disaster and can occur anywhere in the country. Recent inland flood events and increased frequency of hurricanes highlight the very real risks facing property owners," said Cassie Masone, vice president of flood operations at Selective Insurance. “Homeowners and renters often have a false sense of confidence that a flood won't impact them because they are far from bodies of water, but changing weather patterns and evolving topography make it more important than ever to have a flood insurance policy."

Additionally, consumers have significant misconceptions about flooding causes and what is and isn't insured under their homeowners or renters policies. Sixty-two percent believe that major storms,

like hurricanes or tropical storms, are among the most common causes of large-scale flooding, not taking into account other common causes like persistent rainfall (59%), river and lake flooding (49%), levee or dam breaks (33%), rapid snow melt (30%) and ice jams (16%). Another cause that consumers didn't list is wildfire-charred land, which is prone to flooding because it can't absorb rainfall.

The week of February 22, 2024, brought more winter storms and flood threats to California, which has been saturated by atmospheric storms and flooding this winter. Heavy downpours on Tuesday and Wednesday flooded streets and sidewalks in San Francisco, with mudslides closing roads to the north and south, ABC News reported, while the Los Angeles area has recorded around 10 inches of rain in February so far. The latest storms come weeks after an earlier winter storm brought severe floods and mudslides to the state.

However, few homeowners in California have flood insurance, with Trevor Burgess, CEO of Neptune Flood, placing the amount at 2% in January 2023. In its survey, Neptune found respondents haven't purchased flood insurance because they don't believe they are at risk (61%), followed by it not simply being on their mind (30%), not having disposable income (29%) and believing it was too expensive (28%).

RECORDING PHONE CALLS WITH CLIENTS

In today's digital age, where communication is often conducted over phone calls, insurance agents have increasingly turned to recording client conversations. Whether for training purposes, dispute resolution, or simply to ensure accurate documentation, capturing conversations can be a valuable tool. However, amidst the convenience of digital recordings, agents must establish a process for consistent documentation. From adhering to legal requirements to ensuring the call recording is accessible years in the future, having structured protocols in place is paramount. In this article, we delve into the importance of establishing clear procedures for which phone calls should be documented and saved in an agency management system.

First and foremost, insurance agents must operate within the bounds of applicable laws and regulations governing the recording of phone conversations. Wisconsin is a single-party consent state; however, for a phone call recording to be admissible in a Wisconsin court or played for any third party, twoparty consent is required. Only one party must consent to the recording if you strictly intend to use phone call recordings for internal purposes. If you foresee utilizing the recording in the future to replace documentation, you should establish two-party consent for phone calls. It’s best to ensure you have a disclaimer automatically stated for inbound calls and that employees know the need to read a disclaimer on outbound calls.

• A sample disclaimer for inbound calls may be: “This call may be recorded for quality assurance and training purposes.”

• For outbound calls, it may be: “Hello, this is [name] calling from [agency] on a recorded line…”

Beyond the legal requirements, insurance agents should prioritize transparency and respect for their client’s privacy by having a recording disclaimer.

Once you’ve established compliance with legal requirements, it’s important to consider if and how you will store the recordings. Certain VoIP systems may integrate and automatically attach to your agency management system, but there may be exceptions. If the phone call recording isn’t automatically documented in the agency management system, it could be downloaded from the VoIP system. Many VoIP platforms only store phone call recordings for anywhere from 30 days to over one year. To document a client conversation, the call may need to be kept for longer than the phone system saves recordings.

By establishing standardized procedures for initiating, conducting, and storing recorded conversations, agents can streamline communication processes and ensure consistency in documentation. This facilitates easier access to important information and minimizes the risk of discrepancies in client records.

While call recordings can be useful if they follow state guidelines and are consistently stored and documented, an agency must determine why they are choosing to record phone calls. It is hard to replace the value and effectiveness of a follow-up email to the client reviewing the conversation that was had verbally. The agency should consider what documentation they would prefer and what customer experience they are looking to deliver.

This can create an easier path to a court finding that a greater duty to advise exists due to a special relationship being formed.

Never Say “Best Coverage”

Clients may be looking for the “best coverage” at the “best price,” but it can oftentimes be unattainable or difficult to know the policy language of each carrier an agent represents, especially in a rapidly changing environment. Remember, insurance agents procure coverage or may assist with submitting claims on behalf of their client, but they do not make underwriting decisions or investigate and determine if a claim is covered. Agents should avoid suggesting a customer’s risk is covered or that coverage always exists for a loss when a separate company makes the underwriting and claims decisions.

It’s Okay to Discuss Your Niche Without Saying, “We Specialize In…”

Many agents or agencies have a niche or focus on a specific type of business. This gives the agent the ability to have a more detailed conversation with the client about their insurance needs. However, when talking about a niche business, an agent should avoid saying “we specialize in…” or “our specialists” as it automatically increases their duty to advise and creates a blanket statement that applies to all employees at the agency. Instead, an agent should talk about their niche along with their experience in that business category.

Avoid Offering “Peace of Mind”

While agents want to offer “peace of mind” to clients, this phrase can be understood as creating an expectation that the insured will not experience an uncovered loss or have any coverage gaps, as they should not have to worry about their insurance coverage. Instead of offering peace of mind to your clients, offer to help them find coverage that matches their described needs or offers greater financial security (including qualifiers in your wording can help!).

As an agent in your local community and beyond, any opportunity to get your name or brand is something to take advantage of. Who knows what that 30-minute podcast or short phone-call interview may lead to in terms of publicity and leads.

By keeping “E&O friendly” language in mind and avoiding words that may give clients a path to establishing a special relationship (and therefore may require a greater standard of care), these marketing opportunities can remain advantageous. Just keep the E&O risks in mind.

HOW WEATHER-RELATED LOSSES FORCED FARMERS AND CROP INSURANCE TO ADAPT

Since 1980, the U.S. has sustained 373 separate weather and climate disasters where overall costs reached or exceeded $1 billion, according to data released by the National Oceanic and Atmospheric Administration (NOAA). The total cost of these events exceeded $2.6 trillion with costs for 2023 events estimated to have exceeded $73.8 billion.

“Recent climate extremes and weather events have had a significant impact on the crop insurance market as a whole," says Michael Deal, executive vice president, chief operations officer, NAU Country Insurance Company, a QBE Insurance Company. “Also, the increased frequency of these events has in turn led to an increased demand for labor and resources—there is not one aspect of our business that hasn't been affected."

Success within the farming industry depends on many things, but most significantly, it rests on climate. Extreme weather has been impacting the agricultural industry for years with crop insurance providing support for many of the losses experienced.

“Prominent examples where crop insurance coverage came into play include the extreme drought in the southern Plains in 2011, coupled with flooding along the Missouri River; the 2012 drought; the 2019 excessive moisture conditions resulting in farmerprevented planting losses; the 2020 Midwest derecho; hurricane losses in the Southeast in 2020; and drought in the northern Plains in 2021," says Dave DeCapp, senior vice president, marketing, Farmers Mutual Hail Insurance.

Between 2001 and 2022, the Federal Crop Insurance Program (FCIP) sent farmers over $161.6 billion in payments for all causes of loss, with weather-related claims representing 73% of total payments, according to a report released by the Environmental Working Group. Payments made to farmers in 2022 were largely concentrated in 10 states and covered mostly four commodity crops including corn, soybeans, wheat and cotton.

However, “common trends being observed in the market include the overall increase in claims activity due to program expansion, changes in weather and policyholder buying patterns," Deal says. “The demand for program expansion and improvement has seen a rise, with a particular focus on shallow losses and subsidy rates."

Over the past number of years, “crop insurance has become the cornerstone of the farm safety net and provides farmers with access to an affordable risk management tool," DeCapp says. As the producer landscape continues to change, it is important for agents to recognize that the makeup of the market is evolving and the value of specialty crops protected by crop insurance has tripled, according to a report by the Economic Research Service (ERS) at the USDA.

The good news is when it comes to participating in crop insurance risk mitigation, it is at an “all-time high, resulting in over 90% of insurable acres being insured, which proves farmers are utilizing the program to mitigate such risk and weather events," says Joe Kirksey, regional director of crop insurance, Gallagher.

“Farmers are also purchasing higher levels of coverage on their policy, which is a necessity to the rising input cost and diminishing profit margins. It is due to the crop insurance program that farmers are able to share this risk by purchasing a policy and ultimately, be able to withstand a disaster to farm another year."

Agents play a key role in ensuring farmers understand and acquire the coverage they need, particularly as the number of adverse climate events continue to rise. It's important to understand that some states that are not known for being in weather-related hotspots may now experience such losses.

For this, Deal offers two tips to ensure agents stay up to date on the coverage available for their clients:

1) Time. Devote as much time as possible to the policyholder's needs. The complexity of the program and the evolving needs and concerns of our farmers must be given the proper attention and evaluation.

2) Education. The industry offers an exemplary amount of continuing education. Attend meetings and training courses in your area and glean as much information as possible. For an agent, knowledge and reliability are everything in this business—and there are a lot of resources out here to support them.

In a world where farmers are facing adverse weather that is increasing in intensity and frequency, “the federal crop program has also evolved over time to accommodate the integration of conservation programs and farmer initiatives to incorporate climate-smart farming practices," DeCapp says. “The guidelines for program participation, based on good farming practices, have also evolved over time." EVERS SIGNS NEW STATE LEGISLATIVE MAPS WITH REPUBLICAN SUPPORT

Wisconsin Democratic Governor Tony Evers secured a major political victory with his recent signing into law of new legislative district maps after the state’s Supreme Court ruled in December last year that the Legislature’s maps were unconstitutional. Republicans, who currently hold large majorities in both houses of the Legislature and have so for some time (Senate 22 GOP to 10 DEM; Assembly 64 GOP to 35 DEM), reluctantly approved the new maps that were proposed by Governor Evers. They made no amendments or changes in order to avoid the high probability of a liberal controlled 4-3 Supreme Court imposing much more unfavorable maps on Republicans. Senate and Assembly Republicans had previously sent the Governor a version of his maps proposal with some modifications, only to have Evers veto the plan because they weren’t identical to his plan.

Democrats, many of whom voted against the Governor’s maps, ironically praised the signing of the new district maps as a significant political victory. The Legislature has been firmly under Republican control for more than a decade, even as Democrats have successfully won 14 of the past 17 statewide elections at the ballot. The new legislative districts mark a milestone in over 50 years that redistricting has passed the Legislature and was enacted by a governor rather than through the courts. Facing a mid-March deadline from the state elections commission for new maps to be in place, Republicans were left with no options and made the strategic decision to support the Governor’s maps and compete to maintain their majorities this fall on the campaign trail.

Under the new maps which will be in effect for the 2024 elections, Republicans maintaining majorities in the State Assembly and State Senate is no longer a guarantee, but they still hold slight advantages going into the election, primarily because they have more incumbents. But the effect of the new maps are certain to make more legislative seats more competitive than they are today. Democrats are almost certain to gain seats in both houses as a result, but it remains an uphill battle for Democrats to flip one or both houses in 2024. Some of this will depend on candidate recruitment, quality and how much of an impact Biden and Trump will have if they win their respective party nominations. Also under the new maps, there are 15 incumbents in the Assembly who will be forced to run against another incumbent and 6 such pairings in the Senate.

Only one of the Assembly pairings would pit one Democrat incumbent against another one. In the Senate, the only Democrat pairing includes an incumbent who has already decided not to run this fall.

Aside from the state legislative maps, the Wisconsin Supreme Court also has been asked by Democrats to take up a challenge to the state's congressional district lines which the Legislature did not take action on. The lawsuit argues the court's decision to order new state legislative maps now opens the door to challenging the congressional map. Republicans currently hold six of eight congressional seats and it remains to be seen whether or not the court will order new maps.

IIAW MEMBER BENEFIT REMINDER: LEGAL SERVICES HOTLINE

My colleagues and I have operated the IIAW Legal Services Hotline since 2011 and it has been a great way for member agents and agencies to get quick answers to relatively basic legal questions (or sometimes find out their questions are not all that basic!) and has helped our firm and the IIAW keep an eye on issues that are important to the industry and the Association. IIAW staff and leadership frequently are asked questions that could easily and more efficiently be addressed to the Hotline, so we thought this would be a good time to devote a column to reminding members that the Hotline is available, and what it can (and cannot) do.

What is the IIAW Legal Services Hotline?

The Association frequently receives member inquiries seeking advice that requires the assistance of legal counsel. In many instances, the questions can be quickly answered by experienced legal counsel. IIAW believes that extending Hotline Legal Services—through the Association’s regular law firm—on a limited basis and at no cost to member agencies is a valuable component of its extensive member benefits offerings. Hotline Legal Services are available to all current member agencies at no charge, subject to certain guidelines.

First, member agencies are entitled to one inquiry with a 15-minute consultation per calendar quarter per agency. We are generally able to inform members at the outset if their question can be properly addressed by the Hotline and within these basic time limits.

Next, the Hotline is restricted to insurance or agency operations questions; it is not in place to answer personal legal questions. Some of the topics members for which make use of the Hotline include:

• Insurance Law and Regulations

• Employment Practices

• Benefits Issues

• Errors & Omissions

• Taxation

• Real Estate

• Business Corporate Law and Succession Planning

Finally, please understand that the attorneys providing the services are counsel to the IIAW and are providing Hotline Legal Services on behalf of the Association. No attorney/client relationship will exist between the caller and the attorney and, thus, we do not offer reviews of particular legal documents or advice that requires clearing formal conflict of interest checks. Advice and information provided (and information received from the member) will be general in nature, both to manage the ethical aspects of the service and because it is not possible to analyze all facts of a problem in just 15 minutes.

How Do You Access the Hotline?

There are two ways to access Hotline Legal Services—Telephone and E-mail. Whichever method you choose, you should receive a response within one business day.

Whether you contact the Hotline by email or telephone, you will need to: (1) identify yourself as an IIAW member seeking Hotline Services; (2) provide the name of your agency so that eligibility can be verified; and (3) give the general nature of your question, so that an appropriate attorney can consult with you. If the attorney who will be counseling the member is unavailable when the call is received, the call will be returned to the agency as soon as possible.

We enjoy providing the Hotline and have found it to be a great way to connect with member agents and agencies over the years. Please keep it in mind when issues arise.

WEST BEND MUTUAL HOLDING COMPANY PLAN PASSES

West Bend, WI (1/23/24) - West Bend held a special Meeting of Members to consider a plan to convert to a mutual holding company. The plan passed on December 8, 2023, with over 90% of the votes cast in favor of conversion. Effective January 1, 2024, the company officially became West Bend Insurance Company and now operates as a stock insurance company under West Bend Mutual Holding Company. West Bend Mutual Holding Company is still owned and governed by its shareholders.

ACUITY CELEBRATES 22ND CONSECUTIVE A+ (SUPERIOR) AM BEST RATING

Sheboygan, WI (2/2/24) - Acuity announced that AM Best has affirmed the insurer’s Financial Strength Rating of A+ (Superior) with a Stable outlook, the 22nd consecutive year Acuity has earned an A+ Financial Strength Rating.

GINA POPP ATTENDS APCIA EMERGING LEADERS CONFERENCE

Fond du Lac, WI (2/9/24) - Gina Popp of Society Insurance has been honored by the American Property Casualty Insurance Association (APCIA) as an emerging industry leader. HARD COPY POOL APPLICATION ELIMINATION

The Wisconsin Compensation Rating Bureau (WCRB) has received approval for the elimination of hard copy applications to the Wisconsin Workers Compensation Insurance Pool (Pool). Effective July 1, 2024, hard copy applications will no longer be accepted.

Online Assigned Risk (OAR), the electronic Pool application, was developed in 2008. Starting July 1, 2024, this will be the only acceptable way to apply to the Pool.

Please see the WCRB website, www.wcrb.org, for more information regarding how to submit OAR applications to the Pool.
