Survey Looks at Accessory Dwelling Units Roughly 20 percent of remodelers undertook projects that created an accessory dwelling unit (ADU) by converting an existing space over the past 12 months, and almost as many created an ADU by building a new addition. Those numbers come from a survey conducted by NAHB as part of its first quarter 2019 Remodeling Market Index. NAHB started addressing this topic in its RMI survey

because it is not possible to detect national trends in ADU creation through existing data sources. ADUs in general require permits, but ordinances vary tremendously across the country, and there are no federal government standards or programs to collect the information in a consistent way. Many property owners may be unaware of, or may even ignore, the requirements. According to a 2006 report from the San

Francisco Bay Area Planning and Urban Research Association, an estimated 90 percent of ADUs in San Francisco as of 1960 were created without obtaining proper permits. Roughly 75 percent of remodelers in the survey reported ADU projects costing at least $50,000, and a substantial 28 percent reported projects costing at least $150,000.

DOJ Files Suit Against Multifamily Properties The U.S. Department of Justice has announced a lawsuit against 82 multifamily properties involving more than 3,000 housing units in Illinois, Indiana, Iowa, Kansas, Kentucky, Missouri, North Carolina, Ohio, Oklahoma, Pennsylvania, Texas and West Virginia. The case is United States v. Miller-Valentine Operations. Alleged violations 4

include accessibility barriers involving steps and inaccessible routes, inaccessible features in kitchens and bathrooms, lack of floor space for wheelchair users to maneuver, and public spaces that do not comply with the ADA.


Court Remands WOTUS Rule Back to EPA In a victory for NAHB and the housing industry, the U.S. District Court for the Southern District of Texas declared that the EPA violated the Administrative Procedure Act when drafting the Obama-era “waters of the United States” (WOTUS) rule in 2015. In 2015, NAHB and the Texas Association of Builders, among others, filed a lawsuit in the Southern District of Texas challenging the definition in the

2015 WOTUS rule. The court has issued a partial decision on NAHB’s summary judgment motion by remanding the 2015 WOTUS rule back to the EPA. However, the court did not vacate the rule.

According to the latest edition of NAHB’s study, “What Home Buyers Really Want,” 46% of recent and prospective home buyers want a security camera in their home, more than any other home technology feature listed in the survey. The next most desired technology features were: video doorbell (45%); programmable thermostat (44%); a wireless home security system (40%), and a multi-zone HVAC system (39%).

Mining Land Offers Affordable Housing Options Daybreak, a mixed- use, walkable community in South Jordan, Utah, is the first project in the region to reclaim surplus mining land and create opportunties for market-rate affordability without additional subsidies. The largest masterplanned community in the state, it is entitled for more than 20,000 homes in the city of about 66,000 located 18 miles south of Salt Lake City. Kennecott Land Company, the developer, was established in April 2001 by international mining company Rio Tinto to convert surplus mining land into mixed-use development. The planned development on

4,200 acres on the west side of South Jordan comprises about 36% of the city’s land area. An intensive and thorough period of remediation, restoration and reclamation for the property lasted through the mid-2000s; construction at Daybreak started in 2003. In 2016, the developer sold its Daybreak assets to Värde Partners, a Minnesota-based global investment firm with a significant presence in Utah. A new company, “Daybreak Communities,” was formed to manage Daybreak’s development. Daybreak incorporates smart growth principles to minimize

sprawl, water use and congestion. The community’s collaboration with Envision Utah — a statewide nonprofit civic engagement organization — provides a guiding vision for the planning and development of the property. The development of Daybreak is divided into 12 “villages,” each planned for approximately 1,000 to 1,500 residential units. It is a good example of creative land use that enables production of more affordable housing. Meet Your HBAS Ambassadors Jennifer is a top notch Ambassador ready to help us grow. Jennifer McDurmon has been with Independent Bank for over 15 years. She started there as a teller in the Thumb area during her senior year of college and grew with the organization as the years went on. Today, Jennifer is an experienced banker, with knowledge in all the aspects of services Independent has to offer. Jennifer graduated SVSU with a BBA in Finance and a minor in Accounting. She is currently doing commercial lending, business treasury services, and community networking at her job with Independent Bank. Jennifer joined the HBA of Saginaw as a way to get more connected with builders in the area and expand business for the bank. She finds the trades

very interesting and loves learning about all the different facets of the industry. This interest led her attending more meetings and events through the HBA, and to her interest in becoming an Ambassador. She says this is the best way to connect with members, and keep them up to date on all the Association has to offer.

She believes in the value of membership, of making sure our members understand and take advantages of those benefits offered by the HBA. Jennifer also supports the trades education of students to help expand the industry’s workforce. Connecting members to each other and helping to grow the HBA is an important aspect of her duties as an

In her spare time, Jennifer enjoys spending time with her husband and their twins, Adam and Addie. The two almosttwo-year-olds keep them on their toes! When she’s not busy, Jennifer enjoys running and camping.

NAHB Concerned about Mailboxes In a letter to members of the House Financial Services Committee, NAHB expressed concerns to federal lawmakers over increased costs and undue burdens to America’s home builders and home owners regarding the use of cluster mailboxes by the U.S. Postal Service. Since 2012, the Postal Service has expressed preference for centralized delivery service, typically to cluster mailbox units. In practice though, this change has resulted in

a de facto mandate for new construction across the nation. By moving to cluster mailboxes in an attempt to save money, the Postal Service is essentially shifting this additional upfront cost to home builders — and ultimately — to home owners. It is unclear who, if anyone, will be responsible for the ongoing upkeep and maintenance of the units or any associated legal liabilities.

Each year, the Council honors local-area students of residential building trades with a scholarship. These students are dedicated to the building industry and have a strong sense of community. EPA Offers Guidance On Groundwater Recent guidance from the EPA seeks to clarify conditions under which ground-water discharges require a permit under the National Pollutant Discharge Elimination System program. The guidance states that 
“... releases of pollutants to groundwater are categorically excluded from the Act’s permitting requirements because Congress explicitly left regulation of discharges to groundwater to the states, and EPA has other statutory authorities.”

High School Students Build Shops for Local Businesses Some local students are putting their education to use by taking the classroom to the construction site. Students are putting the final touches on the new Grand Chalet Shoppes next to Grand Blanc City Hall, all built by the students themselves. The chalet shops will also have a

variety of storefronts, including a woodworking, skin care, and clothing business. “It’s a great opportunity,” said Susan Soderstrom, mayor of Grand Blanc. Soderstrom adds that the Chalets were built with the help of Grand Blanc High School students in their geometry in construction class. Students

said what they learned building the structures will help them in their future. All five Chalets have been rented out and they are set to open next month. “I just can’t wait to get in there and get going,” Keller said. View full article at WNEM.

FAQ Explains New Opportunity Zones In April, the Treasury Department and IRS released a second set of proposed regulations related to the new opportunity zones tax incentive. Established as part of the Tax Cuts and Jobs Act of 2017, opportunity zones provide tax incentives for investors with capital gains to invest in underserved areas affected by poverty and unemployment. The April draft regulations tackled several concerns NAHB raised regarding the proposed regulations released

in late 2018. To maximize the tax benefits, investors must keep their capital invested for periods of five, seven or 10 years. Additional guidance is expected in the coming months to address the administrative rules applicable to a qualified opportunity fund (QOF) that fails to maintain the required minimum investment standards as well as information reporting requirements for eligible taxpayers, including updates to applicable IRS tax forms.

Single-Family Production Mostly in Exurbs In a sign that housing affordability is becoming a growing issue nationwide, exurbs were the only region that registered single-family permit growth on a yearover-year basis in the first quarter of 2019, according to NAHB’s Home Building Geography Index (HBGI). The HBGI is a quarterly measure of building conditions

across the country. It uses county level information about single- and multi-family permits to gauge housing construction growth in urban and rural regions. There are seven regions in this first iteration of the HBGI. At 5.6%, the growth in singlefamily permit activity of exurbs was the highest among the regional geographies in the

HBGI. Exurbs are outskirts of major metropolitan areas that lie beyond the suburbs.

Remodeling Spending by Zip Code Home owners in the average zip code who improve their homes in 2019 will spend $8,327 per improvement, according to recent estimates from NAHB economists on spending on improvements to owner- occupied housing by zip code. Not surprisingly, there is considerable variation across the country. There are many zip code areas where spending per improved home is under $6,500, and many other zip code areas where it

is over $11,000. Zip codes with high spending per improved home tend to cluster around large metro areas, especially in the Northeast. Ten of the top 11 zip codes, in terms of spending per improvement, are in New York State, and the other is in New Jersey. Remodeling projections aggregated to the state level are available here.

Mr. Greg Ugalde, Chairman of the Board National Association of Home Builders 1201 15th Street NW Washington, DC 20005 Dear Greg: On behalf of my fellow senior officers here at the Home Builders Association of Michigan and our 23 local HBAs across the state, I am writing to thank you for two very important things NAHB has done to support our work here in Michigan. First, NAHB has helped our state and its local associations kick-off a new commitment to hold membership drives each and every year. That is our plan moving forward and we truly believe, particularly after seeing Donna Oliver’s presentation and research, that we must encourage and support our locals doing at least one short-duration drive each year. The NAHB Senior Officer’s willingness to send Donna and her team here for three great training sessions last month was truly catalytic in this regard. We didn’t get as many locals to participate in this training as we would have liked, but it has started something here in our state that we intend to sustain over the next several years. Second, I want to draw attention to your research group’s work. Back in 2017 our state association issued a report: “Where will Ten Million Michiganders Live?” that warned of a housing affordability crisis in our state. We used pricing and other affordability data that your research team provided. At the time, we recommended more than a dozen policy action items. One key missing element in our report, however, was a list of ideas and best practices that local communities could enact to try and attract the housing investment they need. While we struggled to get our state housing authority to initiate research on this topic, your research team unveiled a compendium of such ideas from around the country. We discovered this material at IBS and it has now become the starting point of possible actions we have been discussing with our housing authority and other local government interest groups—regarding actions we can encourage around the state. Bottom line: these two examples of help we received from our national association are the tip of the iceberg in terms of the important work your team does at NAHB. In today’s what-haveyou-done-for-me-lately world we often forget to acknowledge and appreciate the work that is done on our behalf. Please know that the above has NOT gone unnoticed. In spite of recovering major ground after the Great Recession, the construction industry is still facing troubling skilled labor shortages, with a lack of qualified candidates stepping up to take over the positions. Today there are a million fewer residential construction jobs than before 2006, according to Tradesmen International. Companies are now looking to technological solutions to shore up operations, increase efficiencies

and do more with less. The use of drone technology and artificial intelligence has gone a long way to cut labor costs and reduce the number of workers needed for complex projects. We’re still a ways off from robots taking over construction jobs, but there are already some companies making construction machinery to do repetitive tasks more efficiently. Companies are increasingly relying on factories staffed by robots, which piece together components of a

home or structure, and the pieces are shipped to their final destination and put together by human workers. Traditionally, construction has had a complicated relationship with technology, but the shortage of skilled labor coupled with the surging demand for building projects has forced the industry to re-evaluate that relationship to make up the shortfall.

The House on the Hillside: Young Architects at Work In an effort to retain privacy and functionality in the sprawling Austrian countryside, two young architects work the landscape. For full article from designboom.com and photos of the home, click here.

Lukas Mähr and Carmen Wurz of MWarchitekten have built a semi-detached house on a hillside in Vorarlberg, Austria. Developed with little resources and with the restriction of the construction site, the project has been carefully adapted to the natural terrain, fitting both respectfully and confidently

into the surroundings. ‘...For private builders, the semidetached house is a financially and resource-efficient solution for living together under one roof...’ In order to create a piece of ecological architecture, the architects studied housing typologies that have been developed over generations. Despite its simple timber frame structure, insulated with

cellulose, the compact volume of the semi-detached house, as well as its three floors of minimum room height, enable it to have an excellent energy balance. The low-energy house is heated by a geothermal heat pump, while fresh air and night cooling are provided by a fully programmable skylight at the highest point of the staircase.
