Fil-Am history month kick-off in Carson honors Olympic gymnast oLYMPIC gymnast and UCLA Bruins artistic gymnast Kyla Briana Ross was bestowed a youth achievement award at the Carson Community Center during the kick off of the Filipino American history month festivities (October 5). Kyla’s mother, Kiana Ross is of Filipino and Germandescent. Her father, Jason Ross is of African American and Japanese ancestry. He was a minor league outfielder.

In her speech, Ross said that whenever she competes, especially in the Olympics, it is not just herself whom she thinks of but she also represents her heritage. Kyla is the top ranked gymnast in the PAC-12 and nationally on vault, bars and all–around gymnastics. She was a member of the 2012 U.S. Women’s Gymnastics Team that was dubbed the Fierce Five. Immigration consultants sentenced for fraud

T

hree immigration consultants operating in Inglewood have received criminal sentences as a result of a joint investigation by the County of Los Angeles Department of Consumer and Business Affairs (DCBA) and California Attorney General’s Consumer Law Section and Division of Law Enforcement. California Attorney General Xavier Becerra announced the sentences on Wednesday. Edgardo Guerrero, who operated “Oficina Guerrero”, was sentenced along with two others for engaging in the unlicensed practice of immigration law and violating California’s Immigration Consultants Act. Guerrero was given a suspended sentence and three years felony probation on condition he serve 270 days of local custody and pay $149,994 in victim restitution. His brother Hector Guerrero was sentenced to probation and public work service, and his wife Sidia Landaverde was granted diversion for one year on condition that victims are paid restitution and community service. All defendants are now prohibited from providing immigration-related services. Guerrero, who is not an attorney, charged undocumented immigrants, who were seeking lawful permanent residence in the United States, and their families thousands of dollars for legal services that he was not legally qualified to give, among other violations. Edgardo Guerrero pled guilty to grand theft and conspiracy to engage in the unlicensed practice of law. Hector Guerrero pled guilty to a violation of the Immigration Consultants Act. Sidia Landaverde pled guilty to

failing to file a tax return. “Those who prey on the most vulnerable consumers must be held accountable,” said Supervisor Mark Ridley-Thomas. “DCBA’s collaboration with the Office of the Attorney General is a strong example of the success achievable when agencies unite around a common goal.” “All consumers in Los Angeles County, including hard-working immigrants seeking legitimate legal immigration services, must be protected from fraudulent bad actors,” said DCBA Director Joseph M. Nicchitta. “We are thankful for the efforts of the Office of Attorney General Becerra and we are glad to play our part in bringing justice to the victims of these crimes.” DCBA’s Office of Immigrant Affairs also hosted workshops in June 2018 to assist more than 200 of Guerrero’s victims and their families. The workshops provided victims with legal assistance and copies of files and personal documents recovered during a search warrant of the business. FROM PAGE 1 counted and wind up losing the most because their services disproportionally rely on federal funds,” Mayra Alvarez, president of Children’s Partnership, told the audience. “And federal funds are driven by census data.” The next chance to get it right won’t come until 2030, when those kids will have missed out on years of educational, nutritional and health care support they’re entitled to – at a rate of thousands of dollars for every person not counted. “We need all the help we can get to make sure it’s a successful count,” said Robert Clinton, 2020 Census project manager for the San Francisco office of Civic Engagement & Immigrant Affairs, which co-hosted the Sept. 27 event at the World Affairs Council with Ethnic Media Services. Attendees represented a broad swathe of diverse communities, from indigenous Mayan speakers from Guatemala to African diaspora members to Eastern Europeans, Asian Indians, Vietnamese-, Chinese-, Filipino- and Korean-Americans – the latter being the immigrant group with the highest undercount. There was broad consensus that getting trusted community messengers to promote the importance of everyone being counted, whatever their age or legal status, would be key. Those messengers could include ethnic media, community service providers and young people themselves. To enlist teens and young adults, EMS announced the launch of a contest for 14-21 year old residents of San Francisco co-sponsored by San Francisco’s OCEIA. Titled “Why My Family Counts,” the contest offers eight $500 first prizes and eight $250 second prizes for a 400-word essay, a work of art, or a 2-minute video/audio of music, rap or spoken word. Entries are due by Dec. 1. Nationwide, in the last decennial census there were a million kids age 4 or younger who weren’t counted. Of those, 10% were in California. Because census data informs approximately three-quarters of a billion dollars annually in federal spending, that undercount cost the state dearly in funding for such programs as school lunches, school breakfast, SNAP, WIC, Head Start and section 8 housing vouchers. “We are risking billions of dollars not coming to our state,” noted Alvarez of Children’s Partnership. California, as a state, has allocated $187 million toward getting everyone counted in 2020, to minimize a potential $3 billion loss of federal funding, she told the audience. “Being counted accurately helps our children thrive,” she said. “The message that kids are our future resonates.” “They have to lead the charge and get their family on board, understanding the impact on their lives and their families’ lives,” said Andre Aikins, who teaches math and works to reduce violence through the organization Alive and Free. He maintained that traditional outreach models may not work with today’s

youngsters. “We have to be very creative. We have to acknowledge that we’re in the digital age. Kids are tapping on phones before they can write. They need color, they need rhymes, music.” San Francisco is home to 115,952 children 18 and younger, according to Clinton – about 13.4% of the population. Some 6.9 percent of these kids live with their grandparents, 47.5% live in rental housing, and only 8% of those between ages five and 17 speak just one language. All these characteristics pose a heightened risk of being overlooked in the census process – and costing their communities the taxpayer support they qualify for. Joining the panel speakers at the event were three San Francisco United School District students, each of whom shared an essay they had prepared for the contest about how, as newcomers to the United States, being counted means being visible. “Every 10 years we count our freedom,” said Talia Kishinevsky, a senior at Ruth Asawa School of the Arts, who described overcoming language and cultural barriers as an odyssey from Ukraine to the United States that her parents began in 1990. When it comes to meeting children’s immediate needs, SFUSD administrator Christina Mei-Yue Wong highlighted three categories of spending based on census data. The $159 million annually dedicated to special education, a combination of $14 million of federal grants, plus state and local dollars. But all of those allocations are based on census data. Similarly reliant on census counts are the national school lunch program, for which more than half of SFUSD’s students are eligible, and Title 1 programs that focus on helping low-income students, Wong emphasized. Losing this kind of support “can lead to a multiplier effect” for the challenges families face, said Hong Mei Pang of Chinese for Affirmative Action. Giving a shout-out to the millions of young people demonstrating worldwide for climate change, Pang praised the student presenters and underscored the key role they will play in encouraging parents to fill out census forms online. Unlike in 2010, she noted, the paper form of the questionnaire will be in English only with a Spanish translation provided if a specific census tract meets the standard – which none in San Francisco have. Census Bureau outreach specialist Son M. Le, a longtime community activist, pointed out that 80% of the kids overlooked in the 2010 census came from families who were counted. Not counting kids is as much a problem of lack of understanding and information as it is about mistrust of government. Recalling his own arrival as a lone teenager in San Francisco’s Tenderloin, Le predicted the success of the census rests finally on people’s willingness to break out of their own isolation, and young people can lead the way.

Making a Difference Miles and Miles Away Jak N Jil Foundation Reaches Out to Neglected Seniors in the Philippines By REY C. ANDRES

ow does one make a difference for a life more purposeful and meaningful?

With the myriad of problems besetting the world, we are simply overwhelmed and drown in the hopelessness that envelops us. But still the thought of doing something different just to let go of that hapless feeling continues to haunt us. How does one make a difference and claim that personal victory of being able to do something meaningful not for ourselves but for others? How to make a difference? “Start by believing in something bigger than yourself. Begin with the belief that you can do something that doesn’t just benefit yourself”, goes one advice.

When the only reason for doing something becomes self-serving, there won’t be much energy that will be required to fuel the momentum needed to go on. Ariane Manalo, founder of Jak N Jil Foundation had wanted to make a difference and for a long time nurtured in her heart a desire to “help the less fortunate especially the elderly”. This gnawing altruistic feeling was one she shared with a friend, Philippine movie director Wenn Deramas, who passed away a few years back. Both Arianne and Wenn have soft spots in their hearts

for the unfortunate. Wanting to perpetuate the memory of her best friend, she mustered enough strength to push through with their chosen advocacy. For ideas, Ariane sought the help of their common friend, Philippine-based Mel de Rosario, an ABS-CBN Television Network Creative Consultant who suggested” Kanlungan ni Maria” an advocacy group in the Philippines that houses and takes care of abandoned elderly. Desirous to make her birthday more meaningful sometime back, she decided to spend her special day doing charitable work at the home for the elderly. An incident she witnessed at Kanlungan proved to be an eye-opener on what immediate project she needed to embark on - something immediate and doable. She witnessed an elderly woman on a wheelchair having a hard time getting into a motorized tricycle

that would bring her medical appointment. Thus, the idea of a customized tricycle specifically designed for the elderly was born. Ariane contacted her architect classmates to help in customizing a wheelchair accessible three-wheeler. (She is herself took up Architecture in the Philippines and later pursued a nursing degree in the U.S and now works as IT Nurse project Manager.) Another friend referred her to a fabrication shop which could manufacture the prototype. To finance her project Ariane established Jak N Jil Foundation in August 2018, to provide her an avenue to generate funds with her friends and colleagues for her project. Two friends, Maru Lazatin and Lally Parcon, joined her in the Foundation where she serves as president. The Foundation held its first fund raising event with a concert held on December 2,

2018 titled “Odette Quesada Live” at Josephine’s Restaurant in Cerritos, Los Angeles with all the proceeds earmarked for the manufacture of the customized tricycle. Arianne delivered the first customized wheelchair accessible tricycle on February 2019, her birthday, to Kanlungan ni Maria with some cash donations. Jak N. Jil Foundation produced its second concert entitled “Party Party na Sabi ni Lola” with performers Valerie Concepcion, Joseph Gelito and Stephen Paysu at the same venue. The full proceeds of the concert will be used to finance the second customized wheelchair accessible tricycle for the abandoned and indigent elderly at another home for the elderly - Josefheim Foundation -which Ariane will personally deliver on February 2020 plus cash to help for other needs of the elderly like diapers.

Ross is a molecular, cell and development biology senior at UCLA. Another outstanding Filipino American, Perlita Rasing, was also honored during the same occasion. Rasing, a retired registered nurse from Alaminos, Pangasinan, formed the Lucap (Hundred Islands) Association, which has since been helping new Filipino immigrants in the U.S. Rasing received the community leadership award. The retired nurse urged the audience to engage in civic work and serving the Fil-Am community. Rasing is a trustee of the Philippine Independence Day Foundation and a past president of the of Carson Women’s Club.

She is also a member of the Sister Cities Association for many years. Both awardees received certificates of recognition from the City of Los Angeles Board of Public Works through its first Filipina American boardmember Jessica Caloza. The said award was presented by Fe Koons and Joselyn Geaga Rosenthal. The board of public works also shared a certificate that honored the City of Carson for holding the Filipino American History month. Joan Ria Salumbides Tagle, president of the Los Angeles Filipino Association (LAFACE) represented the board. Carson Councilmember Jim Dear who is a former history teacher stressed that it is important to learn about the past and the cultural heritage of people. The Fil-Am history month celebration in Carson City will be capped by the 10th annual Larry Itliong Day celebration on October 26 at 8 am at the Veterans Park.

THE LICENSE TO FAIL

t was just one of those Viber calls. I was catching up with one of my sons in the Philippines. Call it mother’s instinct, I immediately sensed there was something wrong.

There was something different about his tone. The usual cheerfulness was absent. He said, he was struggling with his exam week. He’s been up all night but couldn’t make sense of the review material anymore. I heard the anxiety and panic. I calmed him down and asked him- “What are you so worried about?” He said – “I don’t want to fail. I don’t want to disappoint you.” I realized it was a make or break moment. I had to find the right words. What do I say to acknowledge the reality of what my son is telling me? How do I tell him that failing one subject will not define his life, without minimizing his feelings? More importantly, what practical steps can I teach him 7,000 miles away in a few bullet points? I think the most important thing I told my son that night was – “It is ok, Anak. It is ok to fail. I will not be upset. I know you have done your best.” We discussed the consequences if he fails. It was just, to repeat the subject. I also told him that one of his brothers, also failed a subject, three times(!) and they never even heard me talk about it.

Community Minus the fear of failure, he relaxed. He did well in his exam. Failure and disappointment are siblings. It has a finality that’s almost akin to death. People are scared to fail because they are scared to disappoint. Society has dictated that a good life is defined by bullet points. Get done with school, get a job, get married and live happily ever after. Failure is not meeting these expectations. But what if life doesn’t turn out that way. What if your son dropped out of school? What if a business fails and the family home got sold? What if your daughter got pregnant? What if your marriage fails? Everybody talks about how to succeed. But is there a Manual for Failure? Failure is life’s way of teaching us and forcing us to let go. The fear of failure was the reason I stayed in a difficult marriage. In a community of happily married couples, how can you talk about your struggles. Maybe I missed a memo from God that read – “How to have a successful marriage”. A spiritual principle that everybody got except me. For many years, I kept to myself the decay and the abuse. Society’s promise that if I follow the rules, everything will work out, made me stay. Maybe, it will get better. The day I finally admitted to my eldest son that it was not working, was the day I freed myself and everyone. Finally, we can stop pretending. Finally, we can all breathe. That day, I gave birth to my new self. Metamorphosis. It is a beautiful word. It is when we stop crawling and learn to fly. My failed marriage taught me and my kids powerful lessons that no success can. We can always rise from the ashes. We should teach our kids that failure is part of being human. Paola was on the borderline of being positive with an auto-immune disease called Myasthenia Gravis six years ago. Fortunately, she has recently been issued a clean bill of health. “These photographs are my work of pushing myself to achieve the best of what I can do, of pushing to the limits of what I am able to do,” Paola says, adding that: “Being at that point made me maximize every single thing and dropped all my tears.” “I was fearless. I lived my life to the fullest. I made art without limit, I made art for myself. It’s my best creative process, yet.” Paola took up a crash course in photography at the New York Film Academy in 2014. She met someone there who helped her changed her life completely. She was inspired to pursue fine art of photography with great passion. Her interest in black and white photography has drawn her to the challenge of doing nude photography. “I photograph strangers in their most vulnerable state, who choose to submit themselves to the scrutiny of the world and are brave enough to accept the throes that come with being open,” Paola reveals. By doing so, Paola said she is able to present the beauty of her subjects in their vulnerable state while keeping the dignity in their nakedness intact – creating an atmosphere of strength from acceptance and mutual respect. A Greek Roman sculpture-inspired black and white nude photo won Paola 1st place in a monthly photo contest being run by Popular Photography Magazine. The same piece gave her an opportunity to be part of a group photo exhibit in a small museum in Brasov, Romania. Her most recognized photo earned her several invitations to New York photo exhibits. Paola earned a degree in Consular and Diplomatic Affairs course at the De La Salle College of Saint Benilde in the Philippines. In the past, a Filipina domestic helper in Hong Kong, Xyza Cruz Bacani, who moonlighted as a photographer during her days off became popular for posting her photographs of fellow migrant workers on Facebook. Her photography caught the attention of the non-profit, photographic New York-based Magnum Foundation. Bacani was chosen as one of the seven Human Rights fellows given six weeks photography courses at the prestigious New York University Tisch School of the Arts in 2015. Bacani’s life has never been the same again since her first series of photographs made wave on social media. She has been bestowed multiple awards and gained fame and recognition worldwide for her documentaries of migrant workers around the globe.

of it, is the divine in our DNA. Some lessons in life are hard won. Success may be life’s medal, but Failure has taught me more. 1. Extend grace to yourself. Give yourself the license to fail. 2. Love yourself. Get that sleep. Nobody will dream your dreams for you. 3. Set boundaries. Love fully but be ready to walk away. 4. No relationship, friendship or even a job is worth the stabbing pain that causes sleepless nights. 5. One is a whole number. I can be alone and be totally content. 6. I don’t need a man to buy me a good life, but I deserve a man who tries hard to give me one. 7. Learn compassion for other people, especially our children. In my home, failure is not punished. It is not a cause for embarrassment or reprimand. We talk about it and we move on. 8. Talk about it. It makes us more human and approachable. If we talk about failure more, and if we are more accepting, maybe there will be less need for medication. Ironically embracing failure made me powerful. It made me resilient. It also gave me the ability to walk away from anything or anyone. Instead of shunning failure I embraced it and look it in the eye. What is it that you struggle with? A career that is going nowhere? An abusive relationship? A wrong decision? Walk away. Be kind to yourself. Forgive yourself. Give yourself and everyone around you the license to fail. And I know Filipinos fight — a single mom raising three kids by herself. I know that we fight. Panelo rides jeepney, motorcycle to Malacañang

Presidential spokesperson Salvador Panelo on Friday morning made true with his promise to use public transportation in going to Malacañang. Panelo, who took on the challenge made by militant groups, sent photos to media outlets showing him riding a jeepney. He initially called the dare as a "silly challenge" but later changed his mind. Panelo has refused to identify the specific area from where he would start his trip to avoid media coverage. A report on Saksi on Thursday night said the route Panelo was expected to take will start from an unspecified area that is assumed was his residence. He was expected to take a jeep and then the LRT2 at the Betty Go-Belmonte Station to the Legarda station, and then take a short walk to Malacañang. Panelo arrived in Malacañang way past 8 a.m.,

Panelo, in an interview over Dobol B sa News TV on Friday, said his travel started with a jeepney ride at about 5:15 a.m. after about a walk that lasted between 10 to 12 minutes. He said he had to wait for 5 minutes for the jeep to arrive at his area of origin. He also described his experience riding the jeepney. "Mainit, masikip. Sabi ko nga hindi iniintindi ng mga kritiko ang sinasabi ko," said Panelo. "Wala tayong crisis kasi hindi naman tayo paralyzed. Ako kahit naka-kotse, I have to leave hours earlier." After the jeepney ride, he said he will take the LRT2 at the Gilmore station. "Alam niyo laking kalye rin ako. Noong nasa UP College of Law ako, nagji-jeep ako. Nagkamali sila ng hinamon," said Panelo, responding to his critics.

In another interview on Unang Balita around 6 a.m., Panelo admitted that commuting was not an easy task. "Talagang mahirap kasi unang-una gigising ka nang maaga. Pangalawa, makikipaghabulan ka. Pag hindi ka mabilis sumakay ng jeep eh mauunahan ka ng ibang mas bata sayo, mas mabilis," he said. National ID system to benefit farmers, fisherfolk MANILA — About 16.3 million Filipinos who don’t have any proof of identity according to the World Bank’s Identification for Development Initiative are expected to benefit from the first batch of registration for the implementation of the National ID System Law. “The Philippine Identification System Act (Republic Act 11055) is very good because our farmers and fishermen can now seek government help and avail of bank loans. They will no longer be victimized by loan sharks and five-six for their operations,” said Laguna Rep. Sol Aragones. The lack of an official ID, according to the World Bank, hinders these farmers and fishermen from remote areas nationwide to avail of government aid and other services. It was Aragones’ House committee on population and family relations that spearheaded the passage in August 2018 of the PhilSys Act during the 17th Congress that President Duterte signed into law. Aragones said the Bangko Sentral ng Pilipinas, in partnership with the Philippine Statistics Authority, has set aside P3.4 billion for the production of 116 million blank cards, or a cost of P30 per card.

The IDs will be issued until 2022, and the total projected cost is P30 billion. Aragones, a former broadcast journalist, expressed optimism that the rollout of the national ID system will curb corruption in the bureaucracy. The PhilSys law simplifies the processes for services offered both by the government and private companies since only one ID would be required instead of the usual two. Millions of Filipinos do not have two IDs. “This development would weed out possible corruption and ensure that the IDs are rolled out sooner. This is great news so that we can implement the PhilSys law as soon as possible,” she said. Last March, PSA deputy national statistician Lourdines dela Cruz said they are initially targeting about six million individuals, and those eligible to register are Filipinos and resident aliens at least five years old. Information to be gathered for the ID will include biometrics (thumbprint, iris and face scanning), full name, sex, date of birth, place of birth, blood type, address and if one is a Filipino or resident alien. Information about marital status, mobile number and email address

are optional.?After the registration, which is free of charge, the registrant will be given his/her permanent PhilSys number. The corresponding card will be issued a few days later after information is authenticated. The card will serve as the single identification system for all Filipino

CaregiVers working in Residential Care Facilities provide an important service to elderly and disabled individuals, as well as their families. These caregivers often work up to 24 hours per day, providing necessary care and supervision to ensure the health and safety of each facility resident. However, many facility caregivers are grossly underpaid for the services they provide. Fortunately, California law protects caregivers who work in licensed Residential Care Facilities from wage theft. Specifically, all facility caregivers are entitled to receive at least minimum wage for every hour they work, including all hours they are required to be present at the facility. The current minimum wage rate in California is $11.00 per hour for employers with 25 employees or less, and $12.00 per hour for employers with 26 or more employees. Additionally, with some exceptions, facility caregivers are also entitled to receive overtime compensation for all hours worked in excess of 8 per day or 40 per week, and double time compensation for all hours worked in excess of 12 per day. In light of these requirements, facility caregivers, who work 24-hour shifts, must be paid at least $418 per day to comply with California’s minimum wage laws. That includes 8 hours of pay at the minimum wage rate of $11.00/hour ($88), four hours of pay at the overtime rate of $16.50/ hour ($66), and 12 hours of pay at the double time rate of $22/hour ($264). In lieu of paying overtime and double time wages, many employers pay facility caregivers a fixed salary, regardless of the actual number of

hours they work each day. However, paying an employee a fixed salary, predetermined in advance, does not disqualify that employee from receiving minimum wage or overtime compensation. In fact, the salary paid is sometimes far less than the legally required minimum wage. More importantly, payment of a fixed salary to a non-exempt employee only compensates that employee for their regular, non-overtime hours worked. This means that a non-exempt facility caregiver, who receives a set rate of pay or fixed salary for the work they perform, has not been compensated for any hours he or she worked in excess of 8 per day or 40 per week. Furthermore, those uncompensated hours are considered overtime hours, compensable at the legal overtime rate of one-and-one half the facility caregiver’s regular

rate of pay. If you are a facility caregiver receiving a fixed salary for working 24-hour shifts, you may have a substantial unpaid overtime claim. For purposes of illustration, below is an example of how wage and hour claims are calculated for facility caregivers under California law: Tony is a facility caregiver. He works 24-hours per day and is not allowed to leave the care facility at any time during his scheduled shifts. Tony’s employer also requires him to sleep in the facility at night and the residents frequently wake him asking for assistance. Tony receives a daily salary of $100 each day he works. This makes Tony’s regular rate of pay $12.50 per hour ($100/8 hours per day). Subject to that calculation, Tony’s overtime rate is $18.75 per hour and his double-time rate is

Because Tony’s daily salary of $100 does not compensate him for any overtime hours worked, Tony’s employer owes him $375.00 per day in unpaid wages: 4 overtime hours x $18.75 (Tony’s overtime rate), plus 12 double time hours x $25.00 (Tony’s double time rate). If Tony works 5 days per week, he is owed $1,875 per week, which equals $97,500 each year he works. If Tony brings a claim against his employer for these unpaid wages, he can seek unpaid wages going back four years, along with interest, attorney’s fees and costs, liquidated damages and penalties. Chief Justice rules out ‘fixing’ in Robredo poll case

Universal Health Care law Irr signed HealtH Secretary Francisco Duque 3rd signed on Thursday the Implementing Rules and Regulations (IRR) of Republic Act 11223 or the “Universal Health Care (UHC) Law.” The signing of the IRR paves the way for the implementation of the UHC Law, which aims to provide healthcare for all Filipinos. Under the law, all Filipinos will be covered by the Philippine Health Insurance Corp. (PhilHealth). But Duque said, as of now, PhilHealth could only offer up to 85 percent of the “no balance billing” policy specifically for catastrophical diseases such as cancer. “Hindi ito 100 percent na maibibigay sa ngayon, lalo na kung catastrophical ang disease, kasi nga hindi ito kayang tustusan ng PhilHealth (We cannot give 100 percent coverage as PhilHealth does not yet have the budget,” Duque said. Undersecretary Mario Villaverde said it would take time for the program to fully cover all hospitalization expenses. He said the transition period could take two years. The Department of Health said it would need to save up to P1.5 trillion in the next three years to be able to fully implement the intent of the UHC Law. Gov't nurses must be paid no less than P30K, rules Supreme Court Manila — The minimum wage of government nurses should be at Salary Grade 15, the Supreme Court decided on Tuesday. In a decision penned by Senior Justice Antonio Carpio during its en banc session on Oct. 8, the court decided to uphold Section 32 of Republic Act 9173 or the Philippine Nursing Act. Section 32 provides that nurses in government health institutions should be receiving a minimum base pay not lower than Salary Grade 15. "In ruling in favor of the petitioners, the Court ruled that Joint Resolution No. 4, being a mere resolution, cannot amend or repeal a prior law such as RA 9173 or the Philippine Nursing Act. The same applies to EO 811 which is also not a law, but an executive directive," the Supreme Court said in a statement. Under the last tranche of Executive Order 201 signed by former

President Benigno Aquino III, SG 11 and SG 15 are equivalent to a monthly basic pay of P20,754 and P30,531, respectively. The Supreme Court, however, did not grant the appeal of the petitioners to compel the government to implement Section 32 of RA 9173 since "its implementation would necessarily require a law passed by Congress providing the necessary funds for it." Ang Nars Party-list filed a petition at the Supreme Court in 2015 because government nurses have been relegated to Salary Grade 10-11, following the implementation of Executive Order No. 811 issued during the administration of former president Gloria Macapagal-Arroyo. Section 6 of EO 811 mandated that the Salary Grade for the position of "Nurse I" be increased from Salary Grade 10 to 11. THE wife of Batuan, Masbate Vice Mayor Charlie Yuson 3rd, who was gunned down in Manila on Thursday, said she now fears for her life and declared that if something happened to her, Philippine Charity Sweepstakes Office board member Sandra Cam should be blamed. Lalaine Yuson said two of the four men who attacked her husband were Cam’s henchmen. “‘Pag may nangyari sa akin, si Sandra Cam lang may kagagawan (If something happened to me, it would be the handiwork of Sandra Cam),” Lalaine told reporters. California’s Homeless Crisis is Out of Control

Anyone with eyes who has spent more than five minutes in Downtown Los Angeles, San Francisco or Oakland was already painfully aware that the region’s homeless problem has devolved from international embarrassment to becoming a safety issue. I use to take my kids thru Skid Row just to tell them that there is a down side to every situation. But now, I am actually scared to go thru Skid Row downtown LA because it must have grown three to four folds since a few years ago. Why! Who is to blame? Quoted June 2018 from Katy Grimes, Canada free press: “The explosion of California homelessness can be directly linked to the radical left’s determination to empty out the jails and prisons through legislation and ballot initiatives, claiming to be for safe neighborhoods and the well-being of our children. Combine that with the outrageous housing costs and lack of available affordable housing, and California is ground zero for a homeless explosion comparable only to colonies of feral cats. The Democrat-dominated California Legislature has pushed and legislated policies that do nothing to decrease homelessness, and instead invite more of it to the Golden State. And they’ve been greatly assisted by the state’s biased, liberal/left media. Ironically, the failed mayors of hell-hole California cities (Antonio Villaraigosa of Los Angeles, and Gavin Newsom of San Francisco, home of the Human defecation map), are running for Governor of California—just as current termed-out Governor Jerry Brown did, after making Oakland, CA an even bigger drug and crime-ridden hell-hole than it already was.” Now she its worst than before and Gov. Whenever you ask “how many homeless people are there,” you

can take the official number and add to it by maybe a third. (Compounding the underestimation of the problem is the federal government’s restrictive definition of homeless; if you are couch-surfing on a relative’s or a friend’s couch or staying in a motel without a permanent address, you are not homeless. Anyone with eyes who has spent more than five minutes in San Francisco or Oakland was already painfully aware that the region’s homeless problem has devolved from international embarrassment to ungodly humanitarian crisis. But this is not a Bay Area thing—that is, it is a Bay Area thing, but it is also a Los Angeles thing, and an Orange County thing, and—also a Bakersfield thing.

What Caused the Homeless Explosion?

The so-called reforms succeeded in promoting crime by decriminalizing many crimes, and reclassifying violent crimes as ‘non-violent,’” I recently wrote. “Gov. Jerry Brown’s A.B. 109, ‘realigned’ California’s overcrowded prison system, shifting responsibility of repeat, newly classified ‘nonviolent’ offenders from state prisons to county jails. Those released were assigned county probation officers rather than state parole officers. Those newly ‘non-violent’ criminals let out of county jails due to overcrowding are living on the streets, living on our parkways, rivers, and canals, and using the streets as their toilets. Assembly Bill 109, Proposition 47, Proposition 57 decriminalized theft, drug crimes, sex crimes, and emptied out California prisons. Proposition 47 also reclassified shoplifting, grand theft, receiving stolen property, forgery, fraud, and writing bad checks as “non-serious, nonviolent crimes,” and any theft valued at $950 or less as a misdemeanor, even if committed every day. Proposition 57, “The California Parole for Non-Violent Criminals and Juvenile Court Trial Requirements Initiative,” rounded out the undermining of law enforcement in California. The proposition

was poorly written and allows criminals convicted of rape, lewd acts against a child, and human trafficking to be released early from prison. Prop. 57 allows career criminals to be treated as first offenders, and it overturned provisions of victims’ rights legislation like Marsy’s Law, “three strikes,” Victim’s Bill of Rights, and the Californians Against Sexual Exploitation Act. The Obama-Holder prison reform program, which subverted actual law, encouraged states to ignore certain crimes, decriminalize certain crimes, in exchange for receiving extra federal grants… along with a massive homeless population. My Readers, this is a SAFETY ISSUE for us living in California, crime rates are up and law enforcements hand are tied to these ridiculous laws. Debt Problems: You Can’t Change The Past, Only The Future

And unless their income has increased over that period of time, it becomes a struggle to make the debt payments every month. If you don’t have the extra cash lying around every month to make those increasing debt payments, it will only be a matter of time before you start defaulting. And from there it just gets worse and worse until one day you have a big financial emergency in your hands. Some people even resort to borrowing from some credit cards just to pay other credit cards but quickly realize that this strategy doesn’t work and that they are only digging themselves into a deeper financial hole with no way out. The truth is that your debt problems didn’t just suddenly appear out of nowhere. Experience is often our best teacher. It would help to understand what past decisions led you to your present financial circumstances so that you can avoid making the same mistakes again. How Important is it to have a living trust?

Thinking about one's demise is not something people want to spend time thinking about. However reality is that we all have to face this one day. It is just a matter of whether you depart this world prepared or unprepared. If you pass away with at least $150,000 in gross assets and you do not have a living trust (even if you have a will), your beneficiaries would have to open up a probate case before title to the assets can pass to them. When I say gross asset, I mean regardless of how much debt you owe on them. For example if you own a house valued at $350,000 at the time of your death, it does not matter that your mortgage balance is $300,000, a probate case has to be opened in order to pass title to that property. The same is true with other types of assets such as owning a business, a professional practice, bonds, equities, etc. This is a very low threshold to exceed specially in California where real estate prices, even after the economic crisis, remains in the upper end of the curve among the 50 states. Commencing a probate case is expensive and a very slow process. Someone qualified will have to file a Petition with the probate court to have someone appointed as executor or administrator. The Petitioner's attorney gets paid a statutory rate for attorney's fees commencing with 4% of the gross estate. The probate referee will have to be paid for appraising the assets of the estate. If it is necessary to post bond,

the premium on the bond would have to be paid as well. There is also the cost of administering the estate such as selling some of the assets to satisfy the estate's obligations and to divide the estate according to the will or the intestate line of succession if there is no will. The entire process could take up years specially if certain beneficiaries and creditors file certain claims. The probate court file would be public record. On the other hand if you have a living trust, your estate can avoid the entire court system and court supervision. In certain situations, the process may also save you estate taxes which may be substantial if your assets exceed a certain threshold. Basically, you and/or your spouse can be named as the initial trustee of the trust while you are alive. The trustee is the person who manages the trust. This means you retain control of all your assets the same way as if you never had a trust. For revocable trusts, you can later on, at any time during your lifetime, revoke the entire trust if you change your mind. The assets held in your living trust will be managed by the trustee and distributed according to your directions without court supervision and involvement when you pass away. This can save your heirs time and money. Since the trust would not be under the direct management of the probate court, your assets and their value and your beneficiaries' identities would not become a public record. Your heirs and beneficiaries would still have to be not i f ied about t he living trust and advised, among other things, of their right to obtain a copy of the trust.

The following day at 9:00 am, Sept. 21st, we went on a whole day tour of Paphos which included visiting the Paphos Archaeological Park. Its "sites and monuments date from prehistoric times through the Middle Ages. Among the most significant remains discovered were four large and elaborate Roman villas such as: the House of Dionysus, the House of Aion, the House of Theseus and the House of Orpheus - all with superbly preserved mosaic floors." Kathryn Bernardo has been working nonstop the past few months so when she got the chance to take much-needed break, she, in the company of her long-time boyfriend Daniel Padilla, made the most of it. “Can’t believe it went by so fast, but came home with so many great, unforgettable memories!,” she w rote on Instagram as their 10day grand get away in Iceland came to an end. Following the massive success her latest movie, there’s no reason for the 23-yeard-old to not be grateful. “This trip made me realize how lucky and truly blessed I am. So many good things have happened lately (still happening, tbh!) and I honestly couldn’t ask for anything more. He has always guided me towards the right direction so I lift everything up to Him with nothing but a grateful heart,” she said. At the end of her lengthy post on Instagram, Kathryn thanked Daniel. “Finally, we’re ticking another destination off our bucket list! I’m glad to have experienced this with you, @supremo_dp. Viber boss rose to CEO from bakeshop beginnings believing in big dreams SINGaPoRe—Djamel Agaoua checks the Viber app on his phone around after every 10 minutes for updates on the messaging platform that he now leads. Coming from a family of bakers, the 50-year-old French CEO recalled how believing in his dreams pushed him to make a name for himself, and eventually become the big boss of one of the biggest communications apps in the world. “Believe in your dreams. My father was a baker so it was not written that I would be CEO one day, not even of a small company,” he told ABS-CBN News with a chuckle. “Sometimes, you don’t believe in your dreams so you don’t put yourself in a condition to achieve those dreams,” he said. Agaoua, an economics engineer by profession and the youngest in a brood of 4, said his dream of leading a company was no easy feat as he had to support his parents since he was the only one with a college degree. “I didn’t come from a rich family so I had to support my parents…But growing up, our bakery store didn’t earn that much so they needed some support,” he said. Agaoua said he had always wanted to put up his own firm, drawing inspiration from Microsoft founder Bill Gates and Apple’s late boss Steve Jobs. “At the time Bill Gates was creating his company and Steve Jobs was creating Apple and I was really impressed by those guys and I wanted to start a venture but I couldn’t find the right idea,” he said. “It was a difficult journey of course, but being an entrepreneur pushed you take

some risk and to try to push it further and further,” he said. After finishing school for free in France, Agaoua worked for a consultancy firm for about 8 years before co-founding AChatPro, a company that offers information technology services. Agaoua went on to become an investor and board member in several other startups, explaining that the direction he is taking is his way of paying it forward after having businessmen invest in his projects in the past. “Now, today, I’m an investor and support kids that have projects. The only way to make that happen is to knock on all the doors and try to find people who can make [your dream] happen for you,” he said. For breadwinners dreaming of putting up their own company or making a name for themselves in the corporate world, Agaoue advises them to find people willing to invest in their ideas. “They have to support their family of course, but the way I did it is that I convinced people that have money to support me and to invest in my businesses and it’s the only way,” he said. Now, Agaoua continues to lead Viber, 2 years since he was tapped to head the messaging platform. Agaoua took the helm of Viber in 2017, just 2 years after the messaging platform was bought by Japanese international group Rakuten. As Viber’s leader, Agaoua explained that he wants the company to put data privacy as its top priority as he emphasized the need to provide users with an alternative from Facebook’s Messenger. “We think that it’s very important that there’s an alternative to this, a real one not an opportunistic one—one that is based on a very clear strategy…We are here to make business, to offer service that makes sense first of all, that works fast, well, and respects it promises and be able to monetize,” he said. “I’m not saying that we’re gonna beat Facebook or be the winner at the end. Philippines is rich in native delicacies that both tourists and locals alike will surely like. Filipinos love to eat something sweet and filling for merienda (snacks time) or as panghimagas (desserts). One delicacy that is highly recommended is binagol or binangol. This delicacy originated from the Visayas and is made from either taro tubers or grated gabi mixed with condensed milk. It is cooked in coconut shells and wrapped in banana leaves. Binagol used to be found only in Leyte, Tacloban. But because of its delicious taste and popularity, Binagol is now sold in various malls in the Visayas region, and sometimes transported to Manila. To cook this delicacy, the process is quite tedious and takes time. But the taste and sweetness of Binagol after it is cooked is definitely worth it. INGREDIENTS ¾ cups raw taro root (gabi) 1 cup coconut milk (or milk from 2 medium sized coconuts) ¾ cup brown sugar 4 medium sized coconut shells (cleaned thoroughly) 1 oz or ½ can condensed milk (full cream) 4 pieces egg yolks Few pieces wilted banana leaves String DIRECTIONS 1. Mix the taro root, coconut milk, and brown sugar thoroughly. Place a nonstick pan over medium heat, pour the mixture then cook for about six minutes. Stir constantly. 2. Reduce the heat. Continue cooking and stirring the mixture for 10 minutes. 3. After 10 minutes, pour in the condensed milk. Stir-cook the mixture over medium heat for 20 minutes. 4. Pour the mixture into the coconut shells. Create a space in the center of the mixture then place the egg yolk in it. 5. With the use of a tuber mixture, cover the top part of the coconut shell. Spread the mixture smoothly. Ensure that the mixture is close to the shell or the brim. 6. Use two pieces of wilted banana leaves to cover the entire shell. Tie the leaves securely with the use of a string. 7. Place the shells in a steamer and steam the mixture for half an hour. 8. Serve the coconut shells right away.

Since batwan fruits are hard to find outside of the Iloilo area and near impossible to get here in the U.S., you may substitute it with kamias and a package of tamarind powder to flavor the broth. Beef shanks are primarily used to make kansi but pata (beef leg) will be a good cut to add as well for that extra layer of texture and flavor. You may use green jackfruit in the can available in Filipino stores near you.

Lower the heat, cover, and simmer for about 1½ to 2 hours or until the meat is fork-tender. 6. In a small bowl, combine the annatto powder with ½ cup of the broth. Stir until the annatto powder is dissolved and return broth to pot. 7. Add the tamarind soup base. Stir to blend well. 8. Add the lemon grass, green jackfruit, kamias, and chili peppers. Continue to cook for about 10 to 15 minutes or until the jackfruit pieces are heated through. Season with salt and pepper to taste. Serve hot.

Antibiotics abuse: Saving money at the expense of one’s health MANILA — Many cash-strapped Filipinos tend not to finish their dosage of antibiotics in order to save money. Being a single mother with two children, Reyes often looks for ways to keep her daily expenses minimal so she can send her children to school. Philippine National Formulary and National

Antibiotic Guidelines representative Cecilia Maramba-Lazarte said Reyes’ practice is a form of antibiotic misuse which is as dangerous as self-medication. “Self-medication and misuse are forms of antibiotics abuse. Patients don’t go to the doctor, they self-medicate, they ask their neighbor, ano ang ininom mo para sa ganito o noong masakit ang lalamunan mo (what did you take for this or when you had sore throat) MDLinx instead of getting appropriate treatment,” Lazarte said. What is the mechanism behind compulsive sexual behavior?

ompulsive sexual behavior can have a serious negative impact on the well-being of the people it affects. But what are the biological factors behind it? What drives compulsive sexual behavior? A new study looks into the possible molecular mechanisms. Compulsive sexual behavior — which researchers also refer to as “hypersexuality” — is characterized by intrusive sexual thoughts and impulsive sexual behaviors. Although it can have a significantly negative impact on a person’s quality of life, whether compulsive sexual behavior qualifies as a medical condition is still a matter of debate, and the American Psychiatric Association do not yet recognize it as a “disorder.” No clear data indicate just how many people around the world experience symptoms of compulsive sexual behavior, but older estimates suggest a prevalence of about 3–6%. But does compulsive sexual behavior have any underlying biological factors, and if so, which? Researchers have recently tried to find an answer to this question. The team is from the Uppsala and Umeå universities and Stockholm’s Karolinska Institutet — all in Sweden — as well as from the University of Zürich, in Switzerland, and

plays a key role in gene regulation. More specifically, the team assessed 8,852 regions of DNA methylation and the microRNAs — noncoding molecules — that they were associated with. The goal was to find out whether any epigenetic modifications were specific to the participants with compulsive sexual behavior. The team found two specific DNA regions with particular modifications that were only present in individuals with compulsive sexual behavior. These were associated with MIR708 and MIR4456, the genes that encode the microRNA molecules of the same names. One of these forms of microRNA, miRNA4456, normally helps regulate the expression of genes that are involved in the regulation of oxytocin, also called the “love hormone” because it is involved in sexual behavior and pair bonding. Because the MIR4456 gene is affected in people with compulsive sexual behavior, this could mean that they produce unusually high levels of oxytocin, which may lead to unwanted symptoms. However, the researchers emphasize that, so far, this is only a hypothesis — they have not yet been able to confirm it. “Further research will be needed to investigate the role of miRNA4456 and oxytocin in hypersexual disorder, but our results suggest it could be worthwhile to examine the benefits of drug[s] and psychotherapy to reduce the activity of oxytocin,” suggests one of the study’s co-authors, Prof. Jussi Jokinen.

Possible role of gene-regulating mechanisms

Study finds specific DNA differences

In their study paper — which appeared in the journal Epigenetics — the researchers explain that “An increasing number of studies suggest a significant role of epigenetic modifications [...] on sexual behavior and human brain functioning.” Thus, the team “set out to investigate the epigenetic regulatory mechanisms behind hypersexual disorder so [as to] determine whether it has any hallmarks that make it distinct from other health issues,” notes the study’s lead author, Adrian Boström. To do this, the team recruited 60 participants — both male and female — who expressed compulsive sexual behaviors, as well as another 33 participants who did not. The researchers collected blood samples from all participants and assessed patterns of DNA methylation — an epigenetic mechanism that

In addition to this, the researchers compared these blood samples to another set, which they collected from a separate cohort of 107 individuals, 24 of whom had alcohol dependence. With this second analysis, the investigators were aiming to find out whether there were any common patterns between the epigenetic profiles of the group with compulsive sexual behavior and those of the group with alcohol dependence. In short, they wanted to see if the former shared molecular pathways associated with addiction. This comparison showed that individuals with alcohol dependence and those with compulsive sexual behavior both had under-methylation in the same DNA region. This, the investigators believe, may tie in to the presence of addiction-like symptoms in people who experience unwanted, persistent sexual impulses. “To our knowledge, our study is the first to implicate dysregulated epigenetic mechanisms of both DNA methylation and microRNA activity and the involvement of oxytocin in the brain among patients seeking treatment for hypersexuality.” Adrian Boström and colleagues do, nevertheless, note that their study encountered some limitations, including the fact that the mean difference in DNA methylation between individuals with and without compulsive sexual behavior is only 2.6%, approximately. This, they admit, could mean that the impact is not important enough to actually influence individuals’ behaviors. “There is, however, now a growing body of literature on specific genes suggesting wide ranging [...] consequences of subtle methylation changes (1–5%), especially in complex multifactorial conditions like depression or schizophrenia,” the researchers conclude, suggesting that further studies should not overlook their findings. This will lead to the possibility that you haven’t eradicated all the bacteria,” she said. According to the World Health Organization, repetitive abuse of antibiotics leads to the risk of getting anti-microbial resistance. “This means they (infections) won’t be sensitive to the usual antibiotics anymore and you’ll need stronger drugs to eradicate these bacteria,” Lazarte said. Lazarte cited that pharmaceutical companies have stopped investing in researches in the past years because of small return of investment since antibiotics are prescribed to be taken only for a few days compared to medicines

for lifestyle diseases. “It’s possible that there would be no new ones. Taking antibiotics when we don’t need them will lead to a time when they will no longer be useful,” she added. In line with this, a report of the Antimicrobial Resistance Surveillance Program (ARSP) said that skin infections due to staphylococcus aureus used to be curable with Oxacillin. ARSP is a program of the Department of Health that aims to provide critical inputs to the DOH’s effort to promote rational drug use by determining the status and trends of antimicrobial resistance of selected bacteria to specific antibiotics “In the latest data from ARSP, the Oxacillin resistance is already from 52 percent. Now, we have to use a higher drug-like Clindamycin for oral or if the patient is very sick or septic, we use Vancomycin,” Lazarte said. She added there could only be very few drugs that can be used to cure such infection other than Vancomycin. On September 26, the Department of Health (DOH) launched the online version of the National Antibiotic Guidelines (NAG) to guide health care providers on rational antibiotic use as part of the national effort to fight the growing public health threat of antimicrobial resistance. The NAG also outlines the recommended approach to the treatment of common infectious diseases and aims to facilitate consistency of care and quality use of antimicrobials in all healthcare facilities. “Antimicrobial resistance is now a significant public health threat which causes major health and economic consequences. The irrational use/misuse of antimicrobials was identified as a major driver of antimicrobial resistance (AMR) which has been associated with various management and healthcare provider concerns,” DOH Undersecretary Rolando Enrique Domingo said. According to the 2019 Reader’s Choice Awards survey, Condé Nast Traveler readers have ranked the 30 best islands in the world outside the U.S. The readers ranked islands in Southeast Asia to those in the Mediterranean. For the 32nd annual survey conducted by the CNTraveler, they have gathered a record of 600,000 registered voters. And for 2019, they broke the survey out by region: the best in Asia, Australia and the South Pacific, Carribean and the Atlantic, Europe, North America, and best in the rest of the world. Now that’s quite a list they have there. For the Top 5 in Asia, Cebu’s made it to the 2nd place. Falling behind Boracay Island, that’s not bad at all. As the story goes, Stephen was so fascinated with Amalia that he actually went on a date with her, at another time played golf with her and even invited her to try her luck in Hollywood, prompting Amalia to comment, “I’d rather be a big fish in a small pond than be a small fish in a big pond.” She was Amalia Fuentes

It turned out that Stephen had quit Cleopatra after shooting for a few days and was replaced by Richard Burton (who became Taylor’s husband) but got paid in full anyway, saying, “I was laughing all the way to the bank.” Said Amalia, “That was the first time I ever heard that remark,” which has been quoted through the years. It was during one of their meetings

that Stephen told Amalia, “You remind me of Elizabeth Taylor.” Clarified Amalia, “He didn’t exactly say that I looked like Elizabeth Taylor. He just said that I reminded him of Elizabeth Taylor.”

When did Amalia finally come faceto-face with Elizabeth Taylor?

It happened in the ‘80s when she and estranged husband Joey Stevens watched Elizabeth in the play The Little Foxes in London’s West End. Amalia wore a white dress which she bought during an earlier trip to Italy and purposely wore a curly hairstyle reminiscent of one Elizabeth wore in one of her movies. She and Joey sat in the first row. After the intermission, they could hear whispers (you know, could she be Elizabeth Taylor?) as they returned to their seats. More whispers: “She couldn’t be Elizabeth Taylor. She’s in the play, so why would she sit with the audience?” After the show, Amalia rushed to the backstage door and waited for Elizabeth to come out, ready with her Playbill to be autographed by her. At 5’5” wearing three-inch heels, Amalia towered over Elizabeth who was only 5’1” tall. “I was literally looking at the back of her head,” said Amalia, “so I thought of doing something to make her look at me. I said, ‘You know, I’m also an actress and in my country, they said that I look like you!’ That did it. Elizabeth raised her head and, with her violet eyes (that, I would learn later, turned blue-green when she was under the sun), she looked at me and smiled, saying, ‘Hmmm,’ signed my Playbill and sped away in her chauffeur-driven car.” As of press time yesterday, it is not known if Amalia left a last will and where the wake will be. Aside from Alex, Amalia is survived by the children of her only daughter Liezl, by ex-husband Romeo Vasquez, who died more than a year ago. Liezl succumbed to cancer in March 2015, seven months before Amalia suffered a stroke in Seoul. Her other brother Cheng, father of Aga Muhlach, died last year, barely two years after Amalia’s second husband Joey Stevens died. The couple’s son died in San Francisco more than a year ago. Art installation to depict 40 years of MassKara Festival bacoLoD cITY -- Homegrown artist RJ Lacson will unveil an art installation depicting 40 years of the world-renowned MassKara Festival on the night of October 6 at the fountain area of the Bacolod Government Center here. Dubbed “The Ruby Edition: Looking back and moving forward”, the installation will be “a series of statements in the 40 years of the festival that has tried to define what MassKara is.” This year’s festivity, themed “Bacolod, City of Smiles”, will run from October 7 to 27. Lacson described the masterpiece as “an anniversary-themed tableau presented as a zeitgeist of the moment in creativity and aesthetics inspired from 40 years of the MassKara Festi-
