대한민국 저작권법 제39조에서 제43조까지에 따르면, 대한민국 정부의 관할 아래 있는 모든 저작물은 저작자(공동저작물은 맨 마지막으로 사망한 저작자)가 사망한후 70년, 기업소등이 작성한 업무상저작물은 공표한 때부터 70년이 경과하면 저작재산권이 소멸됩니다.
소리 서류나 방송은 창작한후 50년이 경과하면 저작권이 소멸됩니다. 대한민국 저작권법 제3장 제5절에는 다음과 같이 밝히고있습니다.
저작린접권은 다음 각 호의 어느 하나에 해당하는 때의 다음 해부터 기산하여 70년간 존속한다.
실연의 경우에는 그 실연을 한 때
음반의 경우에는 그 음반을 발행한 때. 다만, 음을 음반에 맨 처음 고정한 때의 다음 해부터 기산하여 70년이 경과한 때까지 음반을 발행하지 아니한 경우에는 음을 음반에 맨 처음 고정한 때
방송의 경우에는 그 방송을 한 때
대한민국의 저작권법(법률제3916호) 부칙 제2조 제1항 및 저작권법(법률제432호) 제35조 제1항, 제36조, 제37조, 제39조에 따라, 1976년 12월 31일 이전에 저작된 사진, 사진술 같은 방법에 의하여 제작한 저작물은 저작권이 소멸되였습니다.
대한민국 저작권법 제49조에 의해 개인 저작권자가 상속인없이 사망하거나 법인 또는 단체가 해산되여 민법 또는 그밖의 법률에 의해 저작권이 국가에 귀속될 때도 저작권이 소멸합니다.
