To pass the image into public domain, we need proof of publication. If the image was not legally published, it is still under copyright. PereslavlFoto (talk) 21:32, 4 September 2022 (UTC)[reply]

What sort of proof do you require? Note that the photo would of been taken prior to 1938. Ilenart626 (talk) 12:19, 5 September 2022 (UTC)[reply]
Let us imagine that this photo has been taken before 1938. Then it was firstly published, for example, in 2000. This means that the copyright term started in the year 2000 and will end in the year 2070. If you prove this image was published before 1951, then it will be in public domain. On the other hand, if this photo was firstly published after 1951, it is still under copyright. Russian law states that the archive has no copyright at all, and the rights of the anonymous author are protected for 70 years. Please check Civil Code of Russian Federation, Article 1281. -- PereslavlFoto (talk) 14:02, 5 September 2022 (UTC)[reply]
The link to the archive site does not lead to the source of this image. Anyway, if the image was published by the archive — then its copyright term starts with this recent publishing, so the image will be copyrighted for many years from now. --PereslavlFoto (talk) 14:37, 5 September 2022 (UTC)[reply]
