Have to start the process tomorrow and read the Clark County web page...they said I can charge reasonable storage fees to store their items if it gets to that 6th day and I need to lockout via the court.

Question: Can I hold their items until they pay this "reasonable storage fee" after they've been locked out.

Also, for those that have done an eviction...whats the quickest amount of time from start to finish (tenant hasn't paid and tomorrow is the 17th...won't return calls, dodging me, etc...) I'll be out of town from September 3rd - 9th...think I can get them out before then?

I'm not 100% certain, but I believe the storage fees would go on a tab that you can attempt to collect civilly, no different than tenant damages, etc. I don't think you can hold their items hostage.

In terms of timeline, I doubt you can get them out by Sept 3rd. If you go down tomorrow, they'll serve it Tuesday and they have five business days starting Wednesday for the 5 day pay or quit. Assuming nothing happens then you'll need to go down and file an unlawful detainer suit which they have 5 more business days to respond to plus the court date and then assuming that flies then you'll have lockout on a separate day.

like I said before...financially responsible people are punished in this country.

My tenant drives a brand new leased BMW and has a thousand dollar smart phone...which is directly why I have no rent in my pocket...but I'm the scumbag.

FYI I moved to Vegas because of cheap business taxes, the condos are just a place to throw my cash. LOL -->low interest rates (never needed one)

Moderator cut: Orphaned here's my advice.

1) Forget about the "reasonable storage fee." In fact, forget about everything which might escalate the situation.

2) You should consider yourself fortunate if they leave the property in good enough shape to spruce up and rent to someone else. I have seen several of these situations go totally sideways taking care of things for my aunt.


My advice is, if you get to the lockout stage, hire laborers to move everything into the garage. Get a ton of banana boxes from the supermarket (they'll just give them to you if you ask). Have the laborers put everything in banana boxes and stack them in the garage. Move the furniture as complete as possible, into the garage and fill dressers with clothes. Make the "stuff" footprint as compact as possible. You want the move-out to take as little time as possible. Having crap strewn all over the place is contrary to that goal.

This allows you to clean up everything which isn't the garage, change the locks, and get the ball rolling for your next tenant. When you come to whatever agreement you can with the current tenant, you can open the garage door, keep everything else locked, and let them take their stuff back.

Don't threaten to hold their stuff ransom or you could find the property trashed to the point where insurance adjusters give you the "what were you thinking" talk.

This is one of the reasons I am so down on the average Las Vegan. I have seen first-hand, several times what the riff-raff is capable of. I've dealt with vandals, squatters, deadbeats, addicts, and run-of-the-mill filthy freakin' slobs. I gave my aunt the "here's how you avoid this in the future" talk. And she hasn't had problems since.

Make sure that the course of action of "leaving quietly without damage" is their most attractive option. Otherwise, they might decide to make your life as miserable as they can -- like pouring cement down all the drains.


I CANNOT STRESS THIS STRONGLY ENOUGH: If you take the attitude of "someone is going to pay," that someone will likely be you. Just get them out as painlessly as possible. This is like being sued -- there is no winning. There are only varying degrees of loss.

i would do everything Scoop said, except once boxed and in the garage.. i would spend the $100 for a storage locker and move it there... that way you can show the house immediately...

Deadbeats rarely leave clean houses. I'd be willing to wager a buck that the interior looks like the contents of a dozen garage sales were haphazardly strewn all over the place. Moving the deadbeat tenants' stuff out of the house just adds additional expense of a storage unit and complication for the "getting them entirely out" process.

aardogfsu can still show the property. Nobody has ever balked at stuff in the garage. "That will be long gone by the time you move in." That's always sufficient. As long as it doesn't look like a bomb went off at a Target and the debris was carted to the garage, at least.

I'd only go after the person in small claims court if their credit was good and you wanna hurt them so they can't get credit in the future.

Scoop's advice is good. Move all their junk to the garage, rehab the house and wait the 30 days Nevada forces you to keep their junk. Don't spend extra to get a moving company and store the stuff in a facility, not worth the money.

If your tenant didn't get their stuff within that amount of time, then get get some laborers to haul the stuff off to the dump. If there's anything of value you could try to sell it.

As far as how "fast" the eviction process takes. Earliest would be the 28th if you start working tomorrow and do everything correctly. Last time I did my paperwork through Clark County Justice Court's e-filing system, the judge took 2 days to grant the eviction.

A skilled tenant can screw up the process and stretch it out. More than 90 days if good at it. Not usual but it can happen.

That would be difficult in Nevada unless the LL had really mishandled things.

OP, put their stuff in storage, not the garage. I could tell you what to do, but I think what you should do now is get an attorney to handle it for you. Then, you know everything is perfect and the whole procedure will go much quicker. If you accidentally do one thing wrong and the tenant contests it, you're sunk and have to start over.

I filed dozens upon dozens of evictions in Clark County. If they didn't pay their rent, violated their lease, conducted illegal operations on the property it is not that hard to get them out.
