Raptors 2023/2024 Season Seats Subscription Contest Rules

OFFICIAL CONTEST RULES AND REGULATIONS

1. Agreement: These rules govern the Toronto Star’s Raptors 2023/2024 Season Seats Subscription Contest (“Contest”). No purchase is necessary to enter the Contest. The act of entering the Contest constitutes acceptance of the Contest rules and the decisions of the Sponsor, which decisions shall be final and binding upon all entrants.
   
   
2. Sponsor: The Contest is sponsored by Toronto Star Newspapers Limited (the “Sponsor"). Toronto Star Newspapers Limited is also the prize provider (the “Prize Provider”).
   
   
3.  Eligibility: The Contest is open to legal residents of the Province of Ontario who are eighteen (18) years of age or older (each an “Entrant”). Employees and the immediate family members (including those with whom they are domiciled) of the Sponsor, and of Maple Leaf Sports & Entertainment Partnership, the Toronto Raptors, the National Basketball Association and its member teams, NBA Properties Inc., NBA Media Ventures LLC and each of their respective parent companies, subsidiaries, affiliates, directors, officers, governors, agents, their advertising and promotional agencies (together with Contest Sponsor/Prize Provider, the “Released Parties”) are not eligible to enter the Contest. Determinations of Contest eligibility shall be made in the sole discretion of the Contest Sponsor and shall be final and binding. Maximum of one entry per person.
   
   
4. Contest: The Contest Period begins at 9 a.m. ET on September 15, 2023 and ends at 12:00 a.m. ET on October 16, 2023 (the "Contest Period"). There are two ways to enter the Contest and be eligible to win the prize:
   
   i. Subscribe to THESTAR.COM: During the Contest Period, read these rules, go to www.thestar.com/subscribe/raptors-giveaway/ and subscribe to thestar.com via a $75 annual digital subscription.  You must provide a valid credit card at the time of subscribing.   No refunds will be allowed on the subscription. You can cancel at any time.

   By Email: To enter without subscribing to thestar.com, read these rules and during the Contest Period, email contests@thestar.com with the subject line "RAPTORS SEASON SEATS SUBCRIPTION". Include your full name, a valid e-mail address, postal code and telephone number and answer the following question in 200 words: "What excites you most about the upcoming Raptors 2023/2024 season?” Please note that each email entry must be accompanied by an answer to the foregoing question. Email entries must be received during the Contest Period.  Proof of emailing is not proof of receipt. Maximum of one entry per person. 
   
   
5. Winner Selection: The potential winners will be chosen by random draw from all eligible entries received, which will take place at the Sponsor’s office at 8 Spadina Avenue, Toronto on October 17, 2023. The potential winner will be contacted by telephone or email by a representative of the Sponsor and must reply within 48 hours to maintain eligibility. If the potential winner cannot be contacted within this time period or fails to respond to any attempted contact or incorrectly answers the skill-testing question, such potential winner will be disqualified, their entry will be declared null and void and the Sponsor reserves the right, in its sole and absolute discretion, to select at random another eligible entry, in which event these provisions shall apply to such other eligible entry. In order to be eligible to win, the potential winner must correctly answer a mathematical skill-testing question without assistance or mechanical or electronic aid.
   
   
6. Prizing: There is one (1) prize available to be won, consisting of one pair of Raptors season seat tickets to all Raptors home games during the 2023/2024 regular NBA season. The approximate retail value of the prize is $30,000.00 CDN. Travel and accommodation are not included.
   
   There is no refund or credit for unused or unclaimed portions of the prize. The prize is non-refundable, non-transferable, not for sale and has no cash surrender or redemption value. Sponsor and the Prize Provider reserve the right in their sole discretion to substitute another prize of equal or greater value for any component of the prize, without liability.
   
   
7. Prize Claim: The prize will be coordinated and sent to the winner by the Prize Provider. If the potential winner fails to provide a valid e-mail address, postal address, and telephone number to the Sponsor within 48 hours of notification that they have been selected as the potential winner, such potential winner will be deemed to have forfeited the prize and the Sponsor reserves the right, in its sole discretion, to select another potential winner using the method described above. Sponsor shall not be responsible or liable for unclaimed, lost, damaged, or stolen prizes or for postal or courier delays, strikes or errors. The Sponsor will not email, mail or courier the prize. If the potential winner is unable or unwilling to accept or otherwise redeem any prize on the terms it is awarded, the prize shall be forfeited, and no cash or substitutes will be provided in whole or in part.
   
   
8. Release: Prior to receiving the prize, the winner may be required to show valid photo ID and must sign a declaration of eligibility and release form releasing the Released Parties and each of their related parties from any and all liability in connection with the Contest and/or the prize, confirming compliance with the Contest rules and consenting to the use of their name, image, likeness, video, comments, and photographs, in any and all forms of media, without further compensation, in any publicity carried out by the Released Parties and/or each of their respective advertising and promotional agencies. The signed form must be received by Sponsor within 2 business days of notification or the prize may be forfeited and awarded to an alternate entrant.
   
   
9. Indemnity: By participating in this Contest, you agree to defend, indemnify and hold harmless the Released Parties and each of their respective parents, subsidiaries, affiliates and/or related companies and licensees and each of their officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising, media buyers and promotional agencies from any and all damages, injuries, claims, suits, actions, causes of action, costs, expenses, liabilities or losses of any kind (including but not limited to lawyers’ fees) arising out of or relating to your participation in the Contest; your receipt or use of any prize; or your violation of any term of these Contest rules or your violation of any third party right, including without limitation any copyright, property, or privacy right.
   
   
10. Privacy: The Sponsor uses your personal information to administer this Contest, including contacting, announcing and promoting the winner, and may transfer your personal information to third party service providers (including but not limited to the Prize Provider) in order to perform services such as prize fulfillment and delivery. The Contest is run in compliance with the Sponsor’s privacy policy, which may be found in full at http://notices.torstar.com/privacy-policy/index.html.
    
    
11. Banning: The Sponsor may, in its sole discretion, prohibit any person from entering the Contest whom it believes to be abusing the rules. Such abuse includes entering false information and entering more times than permitted. 
    
    
12. Social Media Disclaimer and Release: This Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook, Inc. or Twitter, Inc. (together, the “Social Media Platforms”) You understand that you are providing your information to Sponsor and not to the Social Media Platforms. Any questions, comments or complaints must be directed to the Sponsor, and not to the Social Media Platforms. By participating in the Contest, each entrant releases and agrees to indemnify the Social Media Platforms and hold them harmless from and against any and all costs, claims, damages, (including, without limitation, any special, incidental or consequential damages), or any other injury, whether due to negligence or otherwise, to person(s) or property (including, without limitation, death or violation of any personal rights, such as violation of right of publicity/privacy, libel, or slander), due in whole or in part, directly or indirectly, to participation in the Contest, or arising out of participation in any Contest-related or prize-related activity, or the receipt, enjoyment, participation in, use or misuse, of any Contest or prize-related activity, whether hosted by Sponsor or a third party.
    
    
13. Other: Odds of winning depend on the number of eligible entries received. This Contest is governed by the laws of Ontario and the laws of Canada applicable therein and is void where prohibited by law. The Sponsor reserves the right to cancel or modify the Contest or the Contest rules at any time without notice. All prizes must be accepted as awarded, are non-transferable and are not convertible to cash. The Sponsor or Prize Provider reserve the right to substitute any prize or portion of a prize with a prize of equal or greater value. All prizes are awarded as-is and no warranties or guarantees are implied or expressed. Neither the Sponsor nor any Prize Provider is liable for any lost, late, misdirected or stolen entries or inability to process entries, or any errors, damage, injury or negligence that may arise in connection with this Contest, including technical issues or failures on any website or software, viruses, website disruptions, malfunctions or website down-time, human error, personal injury or property damage incurred by any Contest entrant. Sponsor is not responsible for any errors or omissions in printing or advertising this Contest. Use of any automated system including robotic or form filling software to enter or participate in this Contest is prohibited and will result in disqualification of all entries by anyone using such assistance. If a dispute arises regarding who submitted an online entry, the entry will be deemed to be submitted by the authorized account holder of the email address provided at time of entry. The authorized account holder is the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
