Advertising enforcement and outcomes

Our role in enforcing the requirements for advertising therapeutic goods in Australia is important to the safety of Australian consumers.

There are sanctions and penalties for advertising that does not comply with the regulations.

Report non-compliant advertising

If you see an advertisement that looks as though it does not comply with the applicable legislation, you can submit a report using our online form.

Before you get started, you should be prepared to provide in-depth information on what concerns you have about a particular advertisement, although you do not need to tell us which section of the legislation you think is being breached.

The information you provide will allow the TGA to gather crucial information about non-compliance that will guide our education, compliance and enforcement work.

Compliance and enforcement tools

The TGA will often work with the responsible entity to provide education and advice in order for that entity to achieve compliance.

However if further action is required, the TGA has the power to use a range of compliance and enforcement tools to address non-compliant advertising of therapeutic goods.

These tools range in seriousness depending on a number of factors, including the nature of the breach, the advertiser's attitude towards compliance, history of non-compliance and potential risk to the public.

Investigation outcomes

The TGA maintains a database listing the outcomes of its investigations into non-compliant advertising.

The details published in relation to each investigation will depend on the complexity of breaches identified and the level of escalation required.
