Customs (Prohibited Exports) Regulations 1958

The Customs (Prohibited Exports) Regulations 1958 allow for the export of otherwise prohibited substances with the permission of the administering agencies. The ODC administers the following regulations:

  • Regulation 10, 10A, 10B, 10AB: Narcotic, Psychotropic Drugs and Precursor Chemicals.

Customs (Prohibited Imports) Regulations 1956

The Customs (Prohibited Imports) Regulations 1956 allow for the import of otherwise prohibited substances with the permission of the administering agencies.

The ODC administers the following regulations:

  • Regulation 5: Narcotic, psychotropic drugs and precursor chemicals
  • Regulation 5A: Antibiotics
  • Regulation 5G: Various substances which include hormones
  • Regulation 5H: Various substances which include anabolic and androgenic substances.

Narcotic Drugs Act 1967

The Narcotic Drugs Act 1967 provides the Commonwealth with powers to meet certain obligations under the Single Convention on Narcotic Drugs 1961, which include regulation of narcotic drug manufacture and cannabis cultivation for medicinal and related scientific purposes.

Narcotic Drugs Regulation 2016

The Narcotic Drugs Regulation 2016 carries out, and gives effect to, the regulatory framework for licensing the cultivation of cannabis and the production of cannabis and cannabis resins for medicinal and scientific purposes, as well as in relation to the manufacture of drugs as provided for under the Narcotic Drugs Act 1967.

The Regulation also specifies the information and documentation that must be provided by an applicant at various key points, e.g. for an application for a licence, a permit associated with a licence under the Act and for any variation of a licence or permit. The Regulation also sets out the arrangements relating to the suspension and revocation of licences and permits, the surrender of a licence, applicable fees and when fees may be reduced or waived.

Narcotic Drugs Amendment Bill 2016

The Narcotic Drugs Amendment Bill 2016 amended the Narcotic Drugs Act 1967 to permit the Commonwealth to allow for cannabis cultivation for medicinal and related scientific purposes in accordance with the Single Convention on Narcotic Drugs 1961.

Prior to the amendment, cannabis cultivation for medicinal and related scientific purposes was prohibited.

Narcotic Drugs Legislation Amendment Act 2016

The Narcotic Drugs Legislation Amendment Act 2016 allows for the protection of sensitive law enforcement information that ODC is required to consider when assessing cannabis licence applications. This means law enforcement agencies can be confident that information provided by them to help assess applications will not be released, which would potentially compromise police operations.

Narcotic Drugs (Licence Charges) Act 2016

The Narcotic Drugs (Licence Charges) Act 2016 enables ODC to accept payments for the annual charge applicable to cannabis licence holders. Annual charges are used by ODC to fund unannounced inspections and other compliance functions.

Narcotic Drugs (Licence Charges) Regulation 2016

The Narcotic Drugs (Licence Charges) Regulation 2016 puts into place the regulatory licence charges for licences relating to medicinal cannabis, commercial cannabis research and non-commercial cannabis research as provided for under the Narcotic Drugs (Licence Charges) Act 2016.

Therapeutic Goods Order No. 93 (Standard for Medicinal Cannabis)

This order will contribute to the safety and efficacy of medicinal cannabis products by ensuring that the products are manufactured uniformly according to a quality standard. The Therapeutic Goods Order No. 93 (Standard for Medicinal Cannabis) is made under subsection 10(1) of the Therapeutic Goods Act 1989.
