Following changes to the EU dual-use list, the following Open General Export Licences have been amended and republished:

Additionally, The Open General Trade Control Licence (Trade and Transportation: Small Arms and Light Weapons) has been updated to reflect the expansion of the list of items subject to Category B of the trade controls (trafficking and brokering):

The OGEL (Vintage Aircraft) has been updated to remove ML10b from the goods schedule, to update the text to refer to the Arts Council and to extend the time-period by which goods must be exported under this licence to six months (rather than three months) for consistency purposes.

Notice to Exporters 2015/29: Export Control Reports and Statistics web pages redesigned

Notice to Exporters 2015/29: new look for statistics and reporting database

The Export Control Organisation (ECO) has redesigned the pages of the searchable database of export control reports and statistics.

The styling and layout of pages has been improved. Functionality and site content remains largely the same, except:

    • Exporters can now include ‘end user type’ as one of their search criteria. Please note that this type of search will be limited to those licence applications for which this data has been collected (see Notice to Exporters 2015/19 for more on the requirement to specify end user type).
    • The Help page has been updated to reflect the new layout.

Notice to Exporters 2015/30: Dual-Use OGELs to be updated

The Export Control Organization is giving fair warning that changes are coming…

As in previous years, the European Commission is planning to update the controls on dual-use goods, software and technology as listed in Annex I to Council Regulation (EC) No 428/2009. (On 22 October 2015, the EU published an update concerning the EU Control List of Dual-Use Items.)

This update will reflect decisions made by the multilateral export control regimes in 2015. Changes include adding new controls, removing other controls (decontrols), as well as changes to certain technical parameters, and other amendments.

The update to the Regulation has been communicated to the European Parliament and Council. The publication date has not been confirmed, but we anticipate these changes to come into effect before the end of 2015.

Please note that the amending regulation will not receive its official registration number until it is published. The changes will come into force the day after being published in the EU Official Journal.

Notice to Exporters 2015/27: MOD Form 680 seminar scheduled for February 11

The Export Control Organization had so much success with its last seminar on the MOD (Ministry of Defence) Form 680 and the assocated process, they've decided to give it a second go. This one will be held on February 11th, 2016, at the Westminster Conference Centre (1 Victoria Street, London), and will cost 75 GBP per attendee. The seminar, which will run from 8:30 AM until 4 PM, will include lunch and refreshments.

Notice to Exporters 2015/21: Dual-Use Goods policy consultation till October 15th

Notice to Exporters 2015/21 – European Commission launches online public consultation on the dual-use export policy review (Regulation (EC) No 428/2009)
17 July 2015

On 15 July the European Commission launched an online public consultation on their review of the EU export control regime for dual-use items (Regulation (EC) No 428/2009).

The Commission are looking to receive comments from all stakeholders on the objectives and review options that are outlined in their Communication (2014) 244 and their likely impact on the EU’s export control policy.

The Commission will use the results to help identify the most suitable regulatory and non-regulatory actions to put these options into effect and to decide on whether amendments should be proposed to Regulation (EC) No 428/2009.

This consultation offers a further opportunity for UK companies to influence the thinking of the European Commission as they continue to review the dual-use export control regime.

The deadline for responses is 15 October 2015.

Notice to Exporters 2015/20: How Iran Nuclear Deal impacts UK businesses

Notice to Exporters 2015/20: Iran Nuclear Deal – information for business
15 July 2015

On 14 July Iran and the E3+3 (i.e. The USA, UK, France, Russia, China and Germany) reached agreement on a Joint Comprehensive Plan of Action (JCPoA) on Iran’s nuclear programme. Under this agreement Iran will take certain steps in respect of its nuclear programme and the International Atomic Energy Agency (IAEA) will verify that it has done so. At that point the economic sanctions against Iran will begin to be lifted in a phased approach. Businesses interested in doing business in Iran should note the following:

    • There has been no immediate change to the sanctions or other restrictive measures against Iran – all existing sanctions will remain in force until the IAEA has verified that Iran has taken the actions that it has agreed to under the (JCPoA). This could take several months.
    • While sanctions remain in place they will continue to be enforced robustly.
    • Even when the phased lifting of economic sanctions begins some UN, EU and US sanctions will continue. In particular the arms embargo, and sanctions targeted at Iran’s nuclear and ballistic missile programmes, and those measures applied because of its human rights record and as a sponsor of terrorism, will remain in place.
    • If Iran adheres to its commitments and sanctions are lifted the Government will help the business and financial sector take advantage of the opportunities that will arise and to promote trade and investment between the UK and Iran. However the decision whether to trade with or invest in Iran remains a commercial one for businesses.
    • Even as sanctions are lifted Iran will remain a challenging place to do business, and banks and other financial institutions may remain reluctant to handle Iran-related transactions while full US sanctions remain in place.
