Further Action Notices and Referral Date Confirmations

E-Verify Further Action Notices and Referral Date Confirmations provide employees with important information and instructions related to Tentative Nonconfirmations (TNC) and how to resolve them.

The TNC process involves two documents:

  • Further Action Notice
  • Referral Date Confirmation

The Further Action Notice will include employee’s information as it was entered into E-Verify. The employer and the employee should review the document together to ensure the employee’s information is accurate.

The Further Action Notice appears when an employee receives a TNC. The employer must select the language of the notice (English or Spanish), print and give the notice to the employee.  The Further Action Notice explains the reason for the TNC and the employee’s right to contest it.

The Referral Date Confirmation appears after the employee decides to contest the TNC and the employer has referred the case. The employer must select the language of the Referral Date Confirmation (English or Spanish), print and give it to the employee.  The Referral Date Confirmation gives the date by which the employee must visit SSA or contact DHS to begin resolving the TNC.
