SAG-AFTRA Prez Ken Howard Endorses NY Local Exec For Union EVP Slot

With just under a week to go before the election for the influential EVP position at SAG-AFTRA‘s first national convention since merging, National President Ken Howard today threw his weight behind NY local President Mike Hodge for the slot. Recently re-elected to his East Coast position, Hodge becomes the second formal candidate for the EVP job. Earlier this week, former AFTRA LA local President Gabrielle Carteris threw her hat in the ring. She is endorsed by former National Co-President Roberta Reardon, who narrowly lost her bid to be NY local president to incumbent Hodge in last month’s local elections. Prior that loss, Reardon was widely expected to run for the national EVP slot. Hodge had endorsed Howard for National President in last month’s SAG-AFTRA election, and Howard in turn backed Hodge and his slate in NY. “Mike Hodge is someone I’ve counted on for strong, steady leadership from the very start of my union service, and he has never failed to deliver,” Howard said in a statement. “I’m tremendously impressed with the way he’s handled things in New York, and it’s important that our national union have leadership that reflects our national footprint. Mike is an independent thinker who members can trust to put the interests of our union first.” The EVP election, voted on by the union’s recently elected delegates, will be held September 26 during the union’s four-day convention in Los Angeles.

CAA & Ashton Kutcher’s Katalyst Sued For $2M By Producer Over DMV Reality Series

Producer Hedda Muskat claims that CAA and Ashton Kutcher’s production company deceived her and pushed her out as Co-Executive Producer on a reality series about the DMV. Claiming breach of fiduciary duty, negligence, and promissory fraud in the complaint filed today in L.A. Superior Court (read it here), the Emmy-winning producer is seeking more than $2 million in damages plus other costs from the agency, Kutcher’s Katalyst Media and company co-owner Jason Goldberg. And she’s very clear about what the fallout from the now scrapped series cost her. “Katalyst’s reckless conduct and CAA’s failure to properly represent or protect Plaintiff has had the ultimate consequence of obliterating Plaintiff’s career in the entertainment industry and her reputation as a producer,” says the 16-page lawsuit. Katalyst sued the state agency for $1.4 million in August 2012 after the DMV pulled out of the proposed TRuTV series. After counterclaims and other legal actions, the parties settled the case earlier this year for $450,000. Some of that money, among other damages, is due to her, says Muskat. A producer on America’s Got Talent and A Current Affair among others, Muskat signed with CAA in April of 2009, according to Friday’s filing.

Cancelled BBC America Series ‘Copper’ Could Continue As A Movie

Copper Movie PossibleEXCLUSIVE: The BBC America series ends Sunday but Copper may get a second life on the big screen. One day after the network announced that the Civil War-era series would be cancelled after two seasons, I’ve learned that co-creator/executive producer Tom Fontana and fellow EPs Barry Levinson and Tom Kelly are considering a movie version. The extensive story arc work Fontana did on a third season has the veteran producer eyeing revamping the material for a movie, sources say, with the potential big-screen version said to look at examining life in America after the death of Abraham Lincoln and the years of Reconstruction. Copper, which Fontana co-created with Will Rokos, was BBC America’s first original scripted series and centers on Irish immigrant cop Kevin Corcoran in 1860s New York City. It premiered in August 2012 with 1.1 million total viewers, the largest audience ever for a BBC America series debut. Copper was renewed last October but lost momentum after its June 23 Season 2 premiere.

Jimmy Fallon Writers Request Draws WGA Complaint

EXCLUSIVE: With the new The Tonight Show launch coming in February, NBC is looking to ramp up Jimmy Fallon‘s writing staff. It is also looking for a lot of free work from potential scribes in guidelines that went out about a month ago. Though not an uncommon practice, such requests are prohibited under WGA rules. In this case, the extensive call for submission packets has triggered a complaint to WGA West filed last week, I’ve learned. The writers are concerned that the more evergreen material could end up on the show even if the writer who submitted it ends up not being hired. The guild is contacting NBCUniversal about the matter. Here’s Fallon‘s submission request:

Below are guidelines for Late Night with Fallon sketch submissions:

STEP 1: DESK PIECES

Applicants should come up with 3 ideas for low-production desk pieces. We’re not looking for scripts for each of them, just a good title, a few sentences that describe the bit and a few examples of what the jokes would be.

STEP 2: ADDITIONAL SKETCH IDEAS

We’re looking for 3 ideas for in-studio character pieces, audience plants, games, or ideas for pre-taped shorts or television parodies. Again, this entails a few sentences that describe the bit and a few examples of what the jokes would be.

STEP 3: ONE FULL SCRIPT

Choose your favorite sketch idea from the steps above and write one full script for it.

STEP 4: MONOLOGUE JOKES

We’d like to see 10 monologue jokes to get a sense of joke writing style.

‘Grand Theft Auto V’ Breaks $1B Sales Record In Just 3 Days

UPDATE, 12:01 PM: Call Of Duty might want to go back to basic training. Grand Theft Auto V has now made more than $1 billion in worldwide retail sales in just three days. That’s a target that previous record holder Call Of Duty: Black Ops II took 15 days to hit after its November 2012 release. Already shattering the previous first day sales record and beating Man Of Steel with its $800 million opening, the latest installment in Rockstar Game’s GTA franchise has now surpassed No. 2 movie of the year so far Despicable Me 2s $840 million global box office. The game is now creeping up on 2013′s top movie Iron Man 3′s $1.2 billion worldwide take.

PREVIOUSLY, WEDNESDAY PM: Looks like the fictional LA of Los Santos left Call Of Duty and Superman in the dust. First-day sales of Grand Theft Auto V pulled in a record $800 million worldwide, according to publisher Take-Two Interactive. AMC Sets ‘Breaking Bad’ Marathon Ahead Of Finale

In the days leading up the series finale, it’s going to be all Breaking Bad almost all the time on AMC. I’ve learned that the cable channel is going to show every episode of the meth-drenched drama from Season 1 onward. The “Countdown To Finale,” as AMC has dubbed it, will start at 8 PM September 25 with the very first episode from January 20, 2008, and goes straight through to the end of Season 4 late on Friday, September 27. The marathon picks up again with the current Season 5 at 11 PM September 28 and goes through the night and day up to the 75-minute series finale at 9 PM September 29. AMC’s freshman Low Winter Sun will be pushed back to a 11:15 PM start time on the Sunday because of the extended finale episode and the one-hour live Talking Bad featuring series creator Vince Gilligan, star Aaron Paul, Giancarlo Esposito, Jesse Plemmons, RJ Mitte, Jonathan Banks and ABC late night host Jimmy Kimmel. OWN Hits Wednesday High With Tyler Perry’s ‘For Better Or Worse’ Debut

Turns out Tyler Perry’s For Better Or Worse is definitely the former and not the latter on its new home on OWN. Having left TBS and moved over to OWN now, the Season 3 premiere of the Perry produced and directed sitcom gave the Oprah Winfrey Network its most watched Wednesday night in the outlet’s almost three-year history with 1.124 million. That was driven mostly by the 9 PM third cycle debut drew 1.5 million total viewers and the 9:30 PM episode pulled in 1.6 million viewers with 1.23 and 1.29 ratings respectively among women 25-54. The previous Wednesday high for OWN was May 29, 2013 when the network got 1.092 million. That was the same night Perry’s comedy Love Thy Neighbor debuted on OWN. For Better Or Worse joins Perry’s drama The Haves And The Have Nots as well as Love Thy Neighbor on the network.

It was a night of winners and wannabe winners Wednesday, with NBC’s America’s Got Talent (2.5/7) and CBS’ Big Brother (2.4/7) wrapping their latest cycles just in time for the fall season, On CBS it was veterans night as Big Brother’s Season 15 came to an end and Survivor (2.6/8) started its 27th cycle with 90-minute episodes each. After a season marred by racial slurs among its contestants, the Julie Chen-hosted Big Brother found its $500,000 grand prize winner. Although the 9:30-11 PM finale dipped just 4% compared with its Season 14 finale on September 19, 2012 and week-to-week it bopped up 4% from its September 11 show, last night ended up being the show’s lowest finale of the last six seasons. With a few new twists on the formula, Survivor: Blood & Water, on the other hand, took a real tumble compared to its Season 25 opener on September 19, 2012. Marking the show’s 400th episode and the top-rated show of the night, last night’s 8-9:30 PM Survivor fell 19% from its previous fall premiere. That makes last night the show’s lowest fall debut in its long long history. Compared to its 90-minute Season 26 opener on February 13, the Mark Burnett-produced show saw an 8% rise among the key demo. With a 2.5/8 rating CBS won the night among adults 18-49 and NBC topped the night in viewers with 9.203 million.

UPDATE: ABC Vows To Fight On As Dish Network Claims Consumer “Victory” In Denial Of Network Ad-Zapping Hopper Injunction; CBS Wins On Retrans Deal Motion

2nd UPDATE, 4:34 PM: This is far from over, ABC says. Dish Network may be claiming a win in today’s split opinion that saw a motion for preliminary injunction by ABC denied but the network says there’s more legal battles to come. Read ABC’s statement here and see Dish’s below: 

Today’s ruling is only a preliminary decision and the first step in the judicial process. We continue to firmly believe that DISH’s AutoHop and PrimeTime Anytime services breach our retransmission consent agreement with DISH, infringe upon ABC’s copyrights, and unfairly compete with the authorized on-demand and commercial-free options currently offered by ABC and its licensees.

UPDATE, 1:58 PM: It might have been a split opinion delivered today in federal court for much sued Dish Network’s Hopper service, but the satellite provider is claiming victory. Read the statement I just got from Dish’s EVP and general counsel R. Stanton Dodge:

This decision is yet another victory for American consumers, and we are proud to have stood by their side in this important fight over the fundamental rights of consumer choice and control. This is the third federal court decision that has sided with DISH on consumers’ right to enjoy television as they want, when they want, including the right to skip commercials, if they so choose.

PREVIOUSLY, 12:59 PM: A mixed result was delivered today for Dish Network’s Hopper in federal court. On the one hand, the satellite provider was spared the preliminary injunction requested by ABC against its ad-jumping DVR service. On the other hand, NY-based District Court Judge Laura Taylor Swain Wednesday denied Dish’s motion to deny CBS’ desire to untangle itself from a January 2012 Retransmission Agreement with the provider.
