With the development of society and economy, China on human rights protection and justice has attracted increasing attention and concern the community. The Sixth Plenary Session of its Sixteenth Central Committee of Chinese Communist Party pointed out that the democratic rule of law, fairness and justice are the basic characteristics of a harmonious society which will greatly facilitate the process of building the rule of law in China. But at this stage,due to various reasons,China’s judicial justice still has many problems of judicial corruption and miscarriages of justice,which greatly damages the administration of justice and authority, the reason is mainly because the relevant systems are inadequate the new situation and it can not solve many social conflicts.In a number of factors that influence the course of justice, the urgent need to reform and improve the criminal system was undoubtedly the evidence in the criminal system. Because the criminal evidence is the core and key of criminal lawsuit, if we want to improve China’s criminal litigation,we must reform and perfect the rules of criminal evidence emphatically However, the rules of criminal evidence at present in our country lacks of complete system on the whole, and the relevance of legislation is also imperfect,which give rise to more complicated problems in the judicial practice frequently and more grievances.all of this is damaging the judicial fairness seriously.In this case,I attempt to sums up some urgent needs to solve through the analysis of the present situation in the rules of criminal evidence, which based on both the macro and micro aspects on the existing system, for example, the lack of protection of the suspect’s legal rights,the lack of rules of witness,and the undefined standard of Illegal evidence. On that basis, I want to make some effective schemes for the improvement of rules of evidence to accord with the national conditions.
Based on Critical Chain Planning Model of Multi Project Management Empirical Research
Critical chain method is the critical path method and program evaluation and review technique in the field of project management in recent years as an important development. Critical chain method to overcome the traditional project management methods have limitations, considering the constraints of resources, optimize the allocation of buffer area to eliminate uncertainty, to optimize the purpose of project planning. In view of the current software development organizations, especially for the military software project development work, how to use critical chain method is effective to solve software project project management problems and improve the efficiency of the work plan will be of great significance. This paper uses the software engineering, project management, systems engineering and the theory of constraints and other research theory and method, is put forward based on critical chain scheduling model and the implementation of software development project management planning process optimization method and verified by examples.In this paper, the related theory are analyzed and studied, on the basis of this, put forward software project organization project management problems, namely because of software project in the planning process is not scientific and not comprehensive, resulting in multiple project time and resource configuration is not optimal, for each project the only resource condition and mutual competition, increase the software development process management difficulty, wasting time, manpower, financial capacity, sometimes even will affect the progress of the project and complete the quality problems, and to explore the solution method. Combined with the theory of constraints, the classical theory and the software development organization specific characteristics, to establish a software project project critical chain scheduling model, put forward software organization resource constraint buffer solutions, according to the software at the actual existence of the actual situation, adopts the effective algorithm to solve the problem of resource conflicts, the main mode of operation for security of higher priority projects preferential access to resources, in order to finish inside the shortest time of higher priority projects, lower-priority items in the resources idle time processing, to the greatest extent to shorten the project the total work time, improve resource utilization rate and work efficiency. The algorithm can according to the different project distinction to treat, set up different project buffer and the buffer size, the effective use of the buffer resource space, improve work efficiency; in addition, the multi project critical chain scheduling model can also on project implementation process to play a regulatory role, effectively control implementation of the project progress.Finally, with the unit three synchronous start project collaborative management as an example, a case study was conducted, through calculation, simulation and implementation of each project, optimized adjustment, and puts forward three projects the overall plan, the project critical chain scheduling optimization model were validated, made good results. Through the example, better performance in software project planning management in the work of critical chain project plan model for software development projects is preferred, will greatly shorten the software project implementation cycle, further improve the scientific plan and implementation.
Research on the Evaluation System of Public Policy Executive Power of Grass-roots Government
Public policy executive power can not only determine the realized degree of social public value, but determine the playing degree of macro-control implementation of government to social economic development. The issues on public policy executive power have been attached highly attention and extensive attention from the Party, the government, and the academia. However, the number of the research results on public policy executive power is less, and the evaluation research is utterly weak and needed, especially for the evaluation research on public policy executive power of grass-roots government in China, which is during the administrative system transformation period. Therefore, the research of evaluation system of grass-roots government public policy executive power can contribute to further enrich public policy executive power system, and also make public policy execute more scientifically, reasonably, effectively.Though systematically analyzing the relevant theories of building evaluation system of public policy executive power of grass-roots government, the meanings, features and evaluation relevant concepts have been defined. Firstly, under the premise relevant results from policy execution, three kinds of representative and dynamic models have been selected as the whole logic line, and analyzing the related support theories about policy execution in-depth. Secondly, according to studying the building of evaluation index system of public policy executive power of grass-roots government, the setting principles, setting and building principles and process have been explicated. On the basis of relevant studies of government execution and policy execution, evaluation index system has been deeply analyzed and its rationality has been tested. Thirdly, according to studying the evaluation model and application of public policy executive power of grass-roots government, clear the principles and process of evaluation, put forward a evaluation method which based on method and difficulty coefficient method, make the comparison of grass-roots governments in different levels and areas compare possible, and G1 select one kind of public policy to simulate analysis, which verified the feasibility of this system. Finally, according to studying upgrading countermeasures of public policy executive power of grass-roots government, main measures have been proposed for each grass-roots government, from which they could find to adjust their actual situation.The research not only provides effective technical support for each grass-roots government clearly realizing the true statements of their own public policy executive power, but also fundamentally promotes the public policy executive power level of each grass-roots government in our country.
Study on the Stress of the Women of Urban Families with Low Subsistence Allowances
With urbanization of our country, members taking the low subsistence allowances in the bottom of the society bear more pressure, and face physical and mental health problems. In this crowd, most individuals are women that suffer pressures both from the social and their family. They are in need of emotional support and help from family, community and social more, social assistance should be changed from only material help to both the material and spiritual help.The article introduces their stress status and coping style used, taking the women of urban families with low subsistence allowances in P District Shanghai as study objects, with the questionnaire and case interview as data collecting methods. This research described the basic characteristics, pressure situation of the women, analyzed major stress sources and the situation of coping style. According to the results of this study, the women are facing pressure from society, family and their own. Positive coping strategies such as problem solving, active interpretation and seeking support are adopted when they encounter stress, and negative coping strategies such as denial, depression, emotional vent are less used. Moreover, this paper proposed the corresponding countermeasures to prevent and mitigate the women’s pressure as the reference resources of social assistance.

With the development of modern science and technology, people’sdemand for environmental quality is enhanced, but the industrial society ofhigh energy consumption, high pollution has brought serious damage to theenvironment. How to construct the legal system in order to solve the increasinglyserious environmental tort problem has been an important issue incontemporary environmental legal system.Based on the analysis of the particularity of environmental tort,environmental tort has the quality of unequal party, wide involving andserious social harm. There should be an effective legal regulation on theenvironment infringement. In this paper, by means of the case study, weresearched the traditional methods of legal regulation in environmental tortissues. We found that the existing legal regulations had certain defects. Themain performance is that the distinction between public and private law hasled to the legal vacuum on legislation. Public law means were limited to the principle of power should work under the law. It cannot timely, effectivelyand flexibly to play a role of punishment in environmental torts. As themeans of relief in civil law, compensatory cannot achieve the goal to be aneffective protection of vulnerable side, thus unable to achieve the essencejustice.In this paper, by the methods of history and comparative research, westudied the system of punitive damages, and found that the system ofpunitive damages worked by the implementation of punitive damages andeffectively made up gaps caused by the distinction between public law andcivil law legal. And people were given the rights to punish maliciousinfringers through legal ways. It has an very important practicalsignificance to make effective punishment on environmental torts, and it isworth of studying for our environment law.
The Evolution of New China’s Diplomatic Strategy
Diplomatic strategy is a set of diplomatic activities made by the diplomatic entities especially the sovereign states from the macroscopic in order to achieve their diplomatic goals. Diplomatic strategy is at the core of a state’s diplomatic activities. The previous studies on China’s diplomatic strategy either focus on the quantitative analysis of history, or on the qualitative analysis by the experience of researchers. Performance Evaluation of PublicService Hebei Local Government
In 2011, it is the beginning of implementation of the Twelfth Five-Year Guideline in China and also the beginning of practicing the government performance management system. However, government performance evaluation is still in a stage of exploration in China. There is no mature experience. Therefore, it is profound and responsible that estimating government performance with an innovative way which is also according to reality.First of all, this paper analysis the background and far-reaching significance of government performance evaluation, the status of government performance evaluation both domestic and abroad, the main content and technical route of this research. Secondly, the author explains relevant concepts comprehensively, such as performance, government performance, performance evaluation of the local government and theoretical basis of local government performance assessment. Factor analysis method and DEA analysis method are also introduced in this article. Afterwards, this paper constructs government performance evaluation index system which including” government public health level, social security and social welfare, basic education level, employment situation, quality of citizen life” five dimensions. This system is combined with Hebei province’s situation, based on previous relevant researches and “Five-insurance” target in speech of 17th National Congress, according to two basic functions of modern government which are social services and social management. Finally, the author selects 11 municipal level cities in Hebei Province as research object and ranks local government performance external effects from precious five dimensions with factor analysis method; internal effect is evaluated by DEA analysis method. Through the projection analysis, countermeasures and suggestions for improving government performance are proposed to local municipalities in Hebei Province.
