Terms and conditions

Introduction

1.1
The Department of Health owns the NHS Choices website. You may access and use this website ('NHS Choices') if you agree to be legally bound by the terms set out below. If you do not agree to be legally bound by those terms please do not access and/or use www.nhs.uk.

1.2
Additional terms for access to and use of ths special message posting facility are set out in the section called 'Patient feedback'. If you agree to be legally bound by those additional terms you may use 'Patient feedback'. If you do not agree to be legally bound by those additional terms please do not access and/or use 'Patient feedback' to post messages.

1.3
NHS Choices is only intended for use by people who live in England.

 

2 Changes to terms

2.1
We may make changes to NHS Choices, including these terms, at any time. You will be legally bound by the updated or amended terms from the first time that you use NHS Choices after we put the changes on-line.

 

3 Intellectual property rights

3.1
For non-commercial use, including personal use, or for use by a registered charity, a not-for-profit organisation or a public sector body, you may copy, download, adapt or print off copies of the materials, information, data and other content included on NHS Choices ('NHS Choices content'). You will need to obtain permission in writing from us before you make any other use of NHS Choices content.

3.2
The rights in images, trade marks, trade names, logos included on NHS Choices are owned by us and/or third parties. You will need to obtain permission in writing from the owner before you may use these images, trade marks, trade names, logos in any way.

3.3
NHS Choices videos and interactive tools are made available to embed in other websites by the Secretary of State for Health, acting through NHS Choices. By using the embed codes for NHS Choices videos and tools you accept and agree to the following terms:

i) You must not alter, adapt, edit, incorporate, modify or translate the video or tool in any way.
ii) You must not alter, adapt, edit, modify or remove the NHS Choices branding.
iii) You must not use the video or tool for purposes that are illegal, derogatory or otherwise objectionable or that bring NHS Choices or any third party into disrepute.
iv) You may not indirectly or directly charge users specifically for accessing the video or tool, or otherwise commercialise such content, nor attempt to re-sell NHS Choices content in any way.
v) You may not directly or indirectly suggest any endorsement or approval by NHS Choices of your site or any non-NHS Choices entity, product or content or any views expressed within your site or service.
vi) NHS Choices has absolute editorial control over all NHS Choices videos and tools.
vii) You should refresh cached content every 24 hours to ensure you have the most up-to-date version.
viii) NHS Choices reserves the right to alter, adapt, edit, modify or restrict the availability of Videos for use on third-party sites.
ix) For information about how we track and collect information for video usage on third-party sites, please see our privacy policy.

These terms may be updated by NHS Choices from time to time. Please review them each time you get new NHS Choices embed code.

All title, ownership rights and intellectual property rights in and to NHS Choices videos and tools shall remain the property of the Department of Health.

4 Disclaimer medical information

4.1
NHS Choices provides medical information for use as information or for educational purposes. We do not warrant that information we provide will meet your health or medical requirements. It is up to you to contact a health professional if you are concerned about your health.

4.2
NHS Choices does not give medical advice in relation to any individual case or patient, nor does NHS Choices provide medical or diagnostic services. 

4.3
If you are a medical or health professional then you are encouraged to use NHS Choices for general information purposes.  However, you should not rely on material included on NHS Choices and we do not accept any responsibility if you do.

 

5 Third party websites

5.1
We do not monitor the content of third party websites. Any link provided on NHS Choices is solely for your convenience. We do not accept any responsibility for any third party website.

 

6 Liability

6.1
We exclude any liability to you should NHS Choices not be available at any particular time.

6.2
We do not accept any liability to you for any of the following types of loss or damage (which you may suffer as a result of your use of NHS Choices) whether the losses were foreseen, foreseeable, unforeseen, unforeseeable, known, unknown or otherwise:

(a)
loss which arose when you first accessed or registered to use NHS Choices (even if that loss results from the our failure to comply with these terms or our negligence);

(b)
any business loss you may suffer, including loss of revenue, loss of profits or loss of anticipated savings (whether those losses are the direct or indirect result of our default);

(c)
loss which you suffer other than as a result of our failure to comply with these terms or our negligence or breach of statutory duty;

(d)
any loss suffered due to the default of any party other than us.

6.3
We do not warrant that NHS Choices or any content will be available uninterrupted or error free, that defects will be corrected, or that NHS Choices or its supporting systems are free of viruses or bugs.

6.4
We do not accept any liability to you if we fail, or are interrupted or delayed in the performance of any obligation because of:

(a)
the non-availability or failure of any telecommunications or computer services, systems, equipment or software operated or provided by you or any third party;

(b)
any other event not reasonably within our control.

6.5
We do not give any commitments or accept any liability to you in respect of NHS Choices content provided by other users of the website or third parties.

7 Remedies

7.1
To the extent that we are practically able to do so, we may terminate your access to any part of NHS Choices at any time without notice if you breach any of the terms. You may terminate your registration for any part of NHS Choices by providing written notice that you wish to terminate your registration to us at Department of Health, NHS Choices Team, Skipton House, 80 London Road, London SE1 6LH

 

8 General

8.1
If any of these terms are determined to be illegal, invalid or otherwise unenforceable then the remaining terms shall remain in full force and effect.

8.2
These terms shall be governed by and interpreted in accordance with the laws of England.
