$7000 and two months wages for sacked tailor

A dressmaker has been awarded $7070 and two months wages after the Employment Relations Authority (ERA) found she was unjustifiably dismissed by a fashion school.

Dorina Nelio began working for the New Zealand Institute of Fashion Technology in Auckland on October 24 last year.

She told the institute she had a "Diploma of Tailor (sic) awarded in 1999 by the People's University Deva, Romania, following six months of full time study".

The institute believed this was equivalent to a New Zealand diploma of tailoring. When they discovered it was not, they fired Mrs Nelio saying she had misrepresented her qualifications.

Mrs Nelio denied misleading her employer and claimed she was unfairly dismissed.

The ERA found in her favour.

"I find that Mrs Nelio was unjustifiably dismissed because she did not misrepresent her qualifications and skills ... rather the institute's directors made assumptions and failed to ask some basic questions during its interview of Mrs Nelio before they offered her the job."

The ERA found the institute effectively dismissed Mr Nelio for "its own inadequate interview and checking process".

Mrs Nelio was awarded $5000 compensation, $2070 in costs and two months lost wages.
