TMZ has obtained
a document that holds the key to Nicole Richie's DUI defense -- she will claim the drug tests cops performed on her were bogus. Life isn't simple!
The declaration, filed today by Shawn Chapman Holley, Nicole's lawyer, states, "Dr. Terence McGee as a defense expert ... will challenge the prosecutor's scientific evidence and the conclusions reached by the drug recognition expert."
The pregnant Richie's trial was set to begin tomorrow morning. Chapman Holley appeared before the Commissioner today and asked for a continuance until August 5, because Dr. McGee is not available until then. The commissioner ordered them back to court tomorrow to decide whether he will grant the request for a continuance.

"Extreme Makeover" dentist
Dr. Bill Dorfman and his bride, "Apprentice" contestant Jennifer Murphy could not bridge the gap and have split after just one year of marriage.
In
documents filed Monday in Los Angeles County Superior Court and obtained by TMZ, Murphy -- who Donald Trump once called "one of the most beautiful women I've ever seen" -- cites irreconcilable differences as the reason for the bust-up.
Mrs. Dorfman, a former Miss Oregon, met the toothy doc at the 2004 Miss USA Pageant, where she was competing. The couple began dating a year later when Dorfman hired Murphy to star in a tooth whitening ad. The couple has no children.
A rep for Dr. Dorfman had no comment.

With a court date tomorrow stemming from her DUI last December, Nicole "The Pillow" Richie did what any pregnant, emaciated, spoiled starlet would do -- flee the country! Oh, Canada!
Taking a cue from the Michael Jackson Children's School of Disguise, Nicole arrived in Calgary hiding behind a pillow with baby daddy-to-be, Good Charlotte's Joel Madden. Lifestyles of the rich and the famous! The unwed couple are up north because Joel's band has a show tonight at the Calgary Stampede -- an A-list rodeo! Apparently, times are not-so-good, Charlotte.
Nicole will be able to enjoy her time at the rodeo, because Wednesday's court date is a motions hearing -- for which she does not need to be present. So while Wrong Way Richie won't personally be attempting to get out of her DUI tomorrow, she'll still be knee-deep in bullsh**t!

Paris Hilton lost track of sister Nicky after getting swarmed at the Grove in Los Angeles last night.
While leaving the movie theaters -- where the Hilton sisters apparently saw Michael Moore's astounding health care docu "Sicko" -- photogs quickly
engulfed the ex-convict as Nicky ran for cover. Paris briefly posed for photos as Nicky disappeared in front of the herd, with Paris stopping to ask, "Where is my sister?"
When Paris finally tracked her down -- Nicky was ready with their getaway vehicle, honking her horn at paps to get them outta her way. That's what sisters are for!

Paris Hilton's DUI/probation violation file has officially been closed -- for now.
TMZ has exclusively obtained
court documents signed by Hilton, proving that she completed her required substance abuse education classes on June 25 -- while she was still behind bars -- er, iron ones. She was released from Lynwood Jail at 12:01 AM on June 26. No hearts in her signature this time!
Hilton isn't totally out of the woods yet; she is on probation until January 2010. However, if she violates probation again, she will face the very same judge who sent her to the pokey in May.

Ron Corning asked Nick point blank about racy vacation pics of him with his girlfriend. Before Corning had a chance to finish the question,
the feed went to color bars, prompting him to say, "There you go, that's how they're responding!"
TMZ contacted Lachey's reps who said, "We did over 25 interviews about MasterCard and the All-Star game this morning and WNYW was the only one that happened with." When asked if WNYW was the only one that went there with the question, the rep added jokingly, "Maybe it was the heat wave that knocked out the feed?" Riiiiight.

NASCAR officials have confirmed that the husband of International Speedway Corp. President Lesa France Kennedy, plastic surgeon Dr. Bruce Kennedy, died today when a plane he was piloting crashed in Florida.
Fire Chief Gerard Ransom of Sanford, Fla. has confirmed at least four other passengers were killed -- including two children.
Kennedy was piloting the twin-engine Cessna 310 aircraft when it went down about 8:40 AM ET. The plane crashed shortly after takeoff from Daytona International Airport.

The Commissioner in the Nicole Richie DUI case did not grant the continuance Nicole Richie wanted. Period.
As TMZ first reported, Richie's lawyer asked for a continuance until August 5th, because her expert witness, Dr. Terence McGee, was not available to testify then. Commissioner Steven Lubell was visibly upset and ordered both Nicole's lawyer, Shawn Chapman Holley, and the prosecutor into chambers. When the Commissioner came out, he said he would not rule on the continuance and ordered all parties into court tomorrow morning at 8:30 AM -- that's when the trial is scheduled to begin.
Seems like Nicole is in a pickle. She flew to Calgary last night with baby daddy Joel Madden, who is performing a gig in the Great White North. Will Nicole bail on the concert and come back to face the Commish?

The magazine's new "Black Label" beverage has only been rolled out at a few outlets this summer, including
Jeff Beacher's Madhouse presented by 944 Magazine at The Hard Rock in Vegas, and the Polaroid Beach House in Malibu -- which hosted a 4th of July party attended by Lindsay Lohan.
The drink, which not yet in stores, is only available only in chest markets.

"Prison Break" star Lane Garrison broke away from Hollywood yesterday to spend a little time with friends on the beach in Malibu yesterday. Take a good look!
The fake con faces real prison time in connection with a December 2 car crash that killed one teen and injured two others. Garrison was behind the wheel at the time of the accident, and was reported to have a blood-alcohol level of 0.20 -- more than double the legal limit – and tested positive for cocaine, too.
The 27-year-old TV star confessed up to vehicular manslaughter, and will be sentenced on August 2. He could face up to six years and eight months in real -- not TV -- prison.

Emma Watson's on her way to being a starlet ... but she's not ready to flip-off the paparazzi -- yet.
TMZ cameras spotted the "Harry Potter" teenage witch shopping at celeb favorite Kitson on uber-trendy Robertson Blvd. yesterday, where she was quick to throw a wave to photogs snapping her pic. When a few cameramen started asking her to
give them the finger, Watson just kept smiling, clearly not understanding the thick American accents of the photogs.
Maria Menounos, who was doing an interview with Watson, explained what paps were asking her to do, and Emma cracked up, shaking her head and saying, "No!!"
She's still got a lot to learn.

Onetime wrestling star, Steve "The Lethal Weapon" Blackman believes the WWE is not responsible for the grisly double-murder/suicide of Chris Benoit ... and he's beseeching the King -- er, Larry King.
TMZ cameras were outside of Larry King's CNN studio in Hollywood last night, where our camera caught Blackman, as well as massive hunks John Cena and Chris Jericho, heading for an interview about Benoit.
Blackman was the only one who chirped up when our photog asked about Benoit's alleged steroid use, attempting to
take pressure away from WWE by saying, "They're not the people to blame for this, any drug habits that started, started independently, long before they got to WWE." Blackman also said the media attention put on Benoit's possible steroid use -- toxicology reports are still pending -- are "blown out of proportion."
The WWE issued a similar statement last month, saying it was too soon to jump to the conclusion of "roid rage," specifically citing the timetable of the brutal murders as proof rage was not a factor, but no scientific evidence.

Nicole Richie's lawyer tried to fool TMZ by going to court a day early, but it didn't work!
We were at the courthouse when Shawn Chapman-Holley appeared. She has not approached the bench yet, but she just told us she will ask the Commissioner to postpone Nicole's DUI trial. It's supposed to start tomorrow. She's asking for a new trial date of August 5.
Chapman-Holley just filed a motion, stating the reason for the continuance -- Nicole's expert witness, Dr. Terence McGee, can't testify until the August date. Dr. McGee is a nationally recognized expert on drug testing. Will Nicole challenge the drug test? If so, what's the deal with the alleged confession -- that she had smoked dope and taken Vicodin before driving the wrong way on an L.A. freeway.
TMZ got its paws on this photo of pregnant Nicole (pillow in face) with baby daddy Joel Madden. The couple was flying out of LAX. Joel's band, Good Charlotte, has a gig tonight in Calgary, Canada.
BTW, if Nicole is convicted, she faces a minimum of five days in the pokey.
UPDATE: Nicole's lawyer and the prosecutor have gone before the Commissioner to discuss the continuance. The Commissioner looked upset and ordered both lawyers into his chambers.

Busted-up with Kate Moss, British rocker/drug bustee Pete Doherty drowned his blues on Sunday with his band Babyshambles during the Oxegen Music Festival sponsored by Heineken in County Kildare, Ireland. Rock on!
The indie band entertained over 80,000 fans at the festival. Over 50 acts performed over the weekend, including the complicated Avril Lavigne, androgenous Mika, and the mysteriously masked Daft Punk.

Something good finally happened for Busta Rhymes in court, as a judge refused to roll all four of his arrests in the last year together into one fat case, as the district attorney had requested.
Rhymes just
walked out of Manhattan Criminal Court, and was all smiles for the cameras, as all four of the charges -- two misdemeanor assault charges, a DUI, and a suspended license charge -- will be handled separately. TMZ is told that the D.A. had sought to try the four cases together for the sake of expediency, but Rhymes thought he'd get a better deal if the cases weren't done in tandem. The rapper rejected a plea deal last month that would've meant a year of jail time and a $1,500 fine.
Rhymes -- real name Trevor Smith -- has been arrested four times in the last 10 months. He's due back in court September 5, and trial dates will be set then, if necessary.
