Maryland wins marriage equality

Maryland voters on Nov. 6 approved the states same-sex marriage law by a 52-48 percent margin. Fairness and equality under the law won tonight, Josh Levin, campaign manager for Marylanders for Marriage Equality, a coalition of groups that included the Human Rights Campaign and Equality Maryland that supported Question 6, said shortly after he announced voters had upheld the law. Were sure to feel the ripples of this monumental victory across the country for years to come. Election Day capped off a long and often tumultuous effort for Marylands same-sex marriage advocates that began in 1997 when three state lawmakers introduced the rst bill that would have allowed nuptials for gays and lesbians. Equality Maryland and the American Civil Liberties Union in 2004 led a lawsuit on behalf of Lisa Polyak and Gita Deane and eight other same-sex couples and

a gay widow who sought the right to marry in the state. Baltimore Circuit Court Judge M. Brooke Murdock in 2006 ruled in favor of the plaintiffs, but the Maryland Court of Appeals ultimately upheld the constitutionality of the states ban on marriage for same-sex couples the following year. State lawmakers in 2011 narrowly missed approving a same-sex marriage bill, but legislators approved it in February. OMalley signed the measure into law on March 1. The Maryland Marriage Alliance, which opposed the same-sex marriage law, collected more than 160,000 signatures to prompt a referendum on the law the group needed to collect 55,736 signatures by June 30 to bring the issue before voters on Nov. 6. Marylanders for Marriage Equality struggled to raise money in the rst months of the campaign, but it ultimately netted nearly $6 million. HRC contributed more than $1.5 million in cash and inkind contributions to the pro-Question 6 campaign, while New York City Michael Bloomberg donated $250,000 in October. Former National Football League Commissioner Paul Tagliabue and his wife

Chan announced a $100,000 contribution to Marylanders for Marriage Equality during an Oct. 2 fundraiser that OMalley, D.C. Mayor Vincent Gray, House Minority Whip Steny Hoyer (D-Md.) and others attended at gay Democratic lobbyist Steve Elmendorfs Logan Circle home. The governor also headlined a star-studded New York City fundraiser for the campaign that gay former Republican National Committee Chair Ken Mehlman hosted in September. The Maryland Marriage Alliance netted slightly more than $2.4 million, which is less than half the amount Marylanders for Marriage Equality raised. The National Organization for Marriage, the Knights of Columbus and the Archdiocese of Baltimore are among the groups that contributed to the anti-Question 6 group. Bishop Harry Jackson of Hope Christian Church in Beltsville, Family Research President Tony Perkins and Dr. Alveda King, niece of slain civil rights leader Rev. Martin Luther King, Jr., are among those who publicly opposed the same-sex marriage law. The Maryland Marriage Alliance came under increased scrutiny as Election Day drew closer. The Blade obtained court documents that indicate the Internal Revenue Service

in 2011 led a lien against Derek A. McCoy, the groups chair, for more than $32,000 in unpaid taxes in 2002 and 2003. He also faced criticism from same-sex marriage advocates for defending a suburban Baltimore pastor who suggested during an October town hall that those who practice homosexuality and approve it are deserving of death. A California minister described gay men as predators during an anti-Question 6 rally at a Baltimore church on Oct. 21 that McCoy, Jackson, Perkins and others attended. Nobody here endorses violence, endorses bullying of any sort in any stance, McCoy said during a Nov. 2 press conference, two days before a Frederick pastor noted during another antiQuestion 6 rally that Superstorm Sandy struck New York City after Bloomberg gave $250,000 to Marylanders for Marriage Equality. We stand collectively to love our community, to love the constituents who are in our churches and within our broader community in the state of Maryland. McCoy said after Election Day the Maryland Marriage Alliance respects the results that have come from a democratic process. The law will take effect on Jan.1.

LGBT Center volunteer charged in shooting


D.C. police and the FBI have yet to disclose whether they uncovered a motive in the Aug. 15 non-fatal shooting of a security guard in the lobby of the anti-gay Family Research Councils headquarters in downtown Washington. Herndon, Va., resident Floyd Lee Corkins II, 28, a former part-time volunteer for D.C.s LGBT community center, has pleaded not guilty to a 10-count grand jury indictment in connection with the shooting, including the charge of committing an act of terrorism while armed. According to the indictment and other charging documents, Corkins allegedly shot the security guard in the arm seconds after he entered the FRC building at 801 G Street, N.W., and told the guard, Leo Johnson, I dont like your politics. D.C. police and ofcials with the FBI said they discovered 50 rounds of ammunition and 15 Chick-l-A sandwiches in a backpack Corkins brought to the FRC building. They said the nding led them to believe Corkins may have planned a mass killing if Johnson had not prevented him from gaining access to the FRC ofces on the buildings upper oors. Some have speculated that Corkins targeted the FRC because of its anti-gay positions and its statements denouncing gay activists for organizing a boycott of the Chick-l-A fast food restaurant chain because its owner has contributed money to anti-gay groups opposed to same-sex marriage. But authorities have yet to disclose whether Corkins is gay or whether they determined his motive for the shooting.

Ofcials with the D.C. Center said they knew little about Corkins other than he volunteered to staff the Centers front desk on weekends for a period of a few months. They said there were no signs of any problems associated with his work. Center ofcials joined local and national LGBT leaders in condemning the shooting. Corkins has been held in jail since the time of his arrest on the day of the shooting. A pre-trial status conference in U.S. District Court is scheduled for Jan. 8.

D.C. hosts International AIDS Conference


More than 30,000 people from around the world gathered at the Walter E. Washington Convention Center in D.C. in July for the International AIDS Conference. Secretary of State Hillary Clinton, former President Bill Clinton, former First Lady Laura Bush, House Minority Leader Nancy Pelosi (D-Calif.,) Bill Gates of the Bill and Melinda Gates Foundation, UNAIDS Executive Director Michel Sidib, Burmese opposition leader Aung San Suu Kyi, The View co-host Whoopi Goldberg and gay singer Elton John were among the politicians, public health ofcials and others who spoke during the gathering that took place in the United States for the rst time since San Francisco hosted it in 1990. (President Obama in 2009 completed the process that lifted the ban on people

with HIV/AIDS from entering the country.) Mayor Vincent Gray and other D.C. ofcials used the conference to highlight the citys ongoing efforts to curb the HIV/ AIDS epidemic in the nations capital. The NAMES Project showcased tens of thousands of panels of the AIDS Memorial Quilt throughout the metropolitan area in July, while the AIDS Healthcare Foundation and other HIV/AIDS service providers protested what they contend is a lack of commitment from the White House and other American politicians to combat the epidemic. U.S. Park Service police arrested Housing Works President Charles King and 12 others who tried to tie red ribbons, condoms and other items to the White House fence following a protest in Lafayette Park. The 20th International AIDS Conference is scheduled to take place in Melbourne, Australia, in July 2014.

Anti-LGBT violence triggers D.C. marches


Two marches and a candlelight vigil were among the actions taken by LGBT activists in response to at least seven widely reported incidents of anti-LGBT violence in 2012, including the murder of a transgender woman at a D.C. bus stop. More than 200 people turned out for a candlelight vigil on Feb. 7 at the site of a city bus stop at East Capitol Street and

Sycamore Road, N.E., to mourn the loss of transgender woman Deoni Jones, 23. Jones was stabbed to death while sitting at the bus stop ve days earlier in an incident that police said could have been motivated by anti-trans hatred. At least three citizens came forward with information that enabled D.C. police to arrest 55-year-old Gary Niles on a charge of second-degree murder while armed in connection with the case. While horried over the Jones murder, activists and the victims family members expressed optimism over the help in solving the case by witnesses who lived in the community where the crime occurred. But less than a month later, three more incidents of anti-LGBT violence took place within a few days of each other, including the shooting of a gay man in a Columbia Heights restaurant. The incidents prompted more than 700 people to participate in a rally and march through the streets of Columbia Heights near where two of the incidents occurred. Police arrested a female suspect in the non-fatal shooting inside the International House of Pancakes restaurant, which they said occurred minutes after the victim was called anti-gay names. The second incident, which occurred on Georgia Avenue, N.W., a few blocks away from the I-HOP restaurant, involved a group of about ve unidentied males who attacked and assaulted a 29-year-old gay man as he was walking to his nearby home. The victim said the attackers shouted anti-gay names as they punched, kicked, and dragged him along the street. He suffered a broken jaw and serious facial injuries. The case remains unsolved. have a traditional view of marriage.

remains unsolved. The other incidents include a non-fatal stabbing of a gay man outside the Howard Theatre in July by assailants he said called him anti-gay names; the beating of a gay male couple as they walked toward their apartment in the citys Eckington neighborhood that same month; and the beating in October of a Latino gay man, which also occurred as he was walking to his apartment in Columbia Heights. Ofcials with the local group Gays and Lesbians Opposing Violence and the D.C. Trans Coalition have said police have improved their outreach to the LGBT community over the past few years, but they said more work is needed by the city to change attitudes that lead to violence against LGBT people.

Trans rights bill dies in Md. Legislature


The Baltimore County Council voted 5-2 on Feb. 21 to approve a bill that bans discrimination against transgender people in the areas of employment, housing and public accommodations. But a similar bill that would cover the entire state died in committee in the Maryland State Senate in April, ending chances for passing the Gender Identity Non-Discrimination Act in the state legislature in 2012. Dana Beyer, executive director of Gender Rights Maryland, a statewide group that led the lobbying campaign for the state bill, said supporters were gearing up to push for the bills passage in the legislature in 2013. Beyer said that while advocates were disappointed in the setback on the statewide bill, the passage of a transgender non-discrimination measure in Baltimore County increased the states population covered under similar protections to 47 percent. She noted that Howard County approved a nearly identical bill in December 2011. Baltimore City and Montgomery County approved similar bills several years earlier. According to Beyer, nearly 95 percent of the states transgender people live in those four jurisdictions. So in that respect, practically speaking, weve done the job, she said, in providing legal protection for transgender people in the state. Political observers sympathetic to the state bill have said Maryland Senate President Thomas V. Mike Miller (D-Prince Georges and Calvert Counties) orchestrated its demise in the Senate Judicial Proceedings Committee. Some observers say Miller acted because he believed the bill didnt have the votes to pass in the full Senate and he didnt want the Senate Democratic leadership linked to the bills defeat on the oor. Others, however, say Miller blocked the bill because he personally opposes it. Millers ofce didnt respond to calls for comment.

Blade publishes names of petition signers


The Washington Blades decision to publish the names of the more than 100,000 Marylanders who signed the petition that prompted the states same-sex marriage referendum sparked outrage among opponents of nuptials for gays and lesbians. Family Research Council President Tony Perkins described this newspapers decision to publish the names of those who signed the petition as nothing short of intimidation. Matt Barber, vice president of Liberty Action Counsel, accused the Blade of homo terrorism. The Blade also received threatening phone calls and e-mails after it published the names on its website on July 12. Maryland Gov. Martin OMalley told the Blade last month when asked about the controversy that he didnt know whether Im qualied to comment on journalistic ethics. Transgender activist Dana Beyer also questioned the Blades decision to publish the names of those who signed the petition that were publicly available on July 12, but gay columnist Andrew Sullivan defended the Blade. Some argue that this is a tool for intimidation or a violation of privacy, he wrote. Im afraid I cannot see that. Signing a political petition is a public act. If you are ashamed of trying to deny

your fellow citizens their civil rights, you probably shouldnt have signed the petition in the rst place. Opponents of the same-sex marriage law eventually collected more than 160,000 signatures that prompted a Nov. 6 referendum on the issue. Maryland voters upheld the statute that OMalley signed in March by a 52-48 percent margin.

Gallaudet suspends administrator for signing marriage petition


The suspension of a senior Gallaudet University administrator who signed the petition that prompted a referendum on Marylands same-sex marriage law sparked outrage a little more than a month before Election Day. Gallaudet University President T. Alan Hurwitz on Oct. 10 announced he had placed Dr. Angela McCaskill, who is the D.C. schools chief diversity ofcer, on paid administrative leave after two lesbian faculty members led a complaint after they discovered she signed the petition. McCaskill, who has been in her current position since Jan. 2011, identied the women as Martina MJ Bienvenu and Kendra Smith during an Oct. 17 press

conference in Annapolis. I was shocked, hurt, insulted, she said through an interpreter, stressing Hurwitz had sought to punish her for her decision to sign the same-sex marriage referendum petition as a private citizen. They have attempted to intimidate me and tarnish my reputation. Same-sex marriage opponents immediately sought to highlight McCaskills suspension as an example of the consequences those who oppose nuptials for gays and lesbians could face if voters upheld the law that Gov. Martin OMalley signed in March the Maryland Marriage Alliance launched an ad that featured McCaskill. Marylanders for Marriage Equality, which backed the same-sex marriage law, and the governor also criticized her suspension. Clergy on both sides of the issue spoke out against the universitys decision to place McCaskill on administrative leave. It is unacceptable for Dr. McCaskill to be professionally sanctioned for merely exercising her right as a citizen in our democracy, Revs. Dont Hickman of Southern Baptist Church in Baltimore and Delman Coates of Mt. Ennon Baptist Church in Prince Georges County, who both endorsed the same-sex marriage law, said in a joint statement that announced they were to hold weekly protests outside Gallaudet to urge administrators to reinstate McCaskill. Gray names trans women to Human Rights Commission


In what LGBT activists considered an historic development, Mayor Vincent Gray on July 11 administered the oath of ofce to transgender advocates Earline Budd and Alexandra Beninda as members of the D.C. Commission on Human Rights. Gray nominated the two for the post and the D.C. City Council conrmed the nominations earlier in the year. The appointments represent the rst time a transgender person has been named to the citys Commission on Human Rights, which acts as an adjudicatory body that enforces the citys Human Rights Act. The act, among other things, bans discrimination in employment, housing, education and public accommodations based on sexual orientation, gender identity and expression, race, religion and ethnicity. Im very pleased and Im looking forward to the challenge and Im always honored to be a representative of my community, Budd said after the swearing in ceremony. Im going to do the best I can in this position and make sure that discrimination ends. Beninda said she was looking forward to joining Budd on the commission Im denitely very excited about getting started, she said. I look forward, myself

and Earline, to be able to represent our LGBT community overall and especially our transgender community in terms of making sure our voices are heard.

Kameny burial delayed indenitely


More than a year after gay rights pioneer Frank Kameny died in his Washington home at the age of 86, an urn bearing his ashes remains in storage at D.C.s historic Congressional Cemetery. News of what became an indenite delay in the burial of Kamenys ashes at the cemetery surfaced in March, when a cemetery ofcial said a March 3 burial ceremony had been abruptly cancelled due to an estate related dispute. Patrick Crowley, the then interim senior manager of Congressional Cemetery, said the dispute was between Kamenys estate, which has legal control over the ashes, and the D.C. gay charitable group Helping Our Brothers and Sisters (HOBS), which owns the burial site. The estate is under the control of Timothy Clark, the heir and personal representative, or executor, of the estate. Both sides have acknowledged that the dispute is over a disagreement about how to transfer ownership of the cemetery plot from HOBS, which bought it earlier this year, to the Kameny estate. HOBS executive director Marvin Carter has said HOBS is willing to sell the plot to the estate at the price the group paid

for it. The estate, through one of its attorneys, said HOBS bought the plot through donations from members of the LGBT community who knew and admired Kameny and HOBS should transfer the title to the plot to the estate rather than sell it. The estate of Franklin Kameny is currently in negotiations in an effort to settle outstanding matters related to the estate, said estate attorney Glen Ackerman in a statement in October. We cannot comment on these negotiations or the status of the various matters as doing so may compromise the progress that has been made thus far. All involved are hopeful that resolution may be reached in the near future. In a separate statement Carter said, HOBS is working diligently and in good faith to resolve all issues concerning the plot at Congressional Cemetery and the nal burial of Franks ashes at the cemetery in a manner and under circumstances that will protect and advance Franks reputation in and contributions to the LGBT community.

Va. prosecutor becomes states rst gay jurist


A Richmond prosecutor in June became Virginias rst openly gay judge. The Richmond Circuit Court approved the nomination of Tracy Thorne-Begland, chief deputy commonwealth attorney for the city of Richmond, nearly a month after members

of the House of Delegates rejected it. I am humbled by the Circuit Courts decision, Thorne-Begland said in a statement. I look forward to serving the citizens of the city of Richmond as a jurist, and over the coming months I hope that my service provides comfort to all Virginians that I remain committed to the faithful application of the laws and constitutions of Virginia and the United States of America. Del. Bob Marshall (R-Prince William County) stressed before the May 15 vote in the House of Delegates that Thorne-Begland, who is a former Navy pilot, misrepresented himself when he failed to disclose his sexual orientation when he enlisted in 1992. State Sen. A. Donald McEachin (D-Henrico,) who sponsored his nomination in the state Senate, applauded the Circuit Court judges for recognizing Mr. Thorne-Beglands skill, qualications and competency and putting aside bigotry, prejudice and false excuses in a statement after they approved his nomination. Equality Virginia, state Sen. A. Donald McEachin (D-Henrico,) who sponsored his nomination in the state Senate and Gov. Bob McDonnell also applauded ThorneBeglands appointment. Former Attorney General Richard Cullen and former Virginia Bar Association President James Meath are among those who backed his nomination. The Richmond Circuit Court had the authority to appoint Thorne-Begland on an interim basis because lawmakers did not ll the vacancy. Lawmakers could rescind the temporary appointment once they reconvene next month.

President Obama wins re-election after endorsing marriage

In perhaps the biggest year for the LGBT rights movement in history, one story stands out as the most signicant of the year: President Obamas re-election after he publicly endorsed marriage equality. Obama won re-election by taking 51 percent of the popular vote compared to the 47 percent won by Republican presidential nominee Mitt Romney, paving the way for the pro-LGBT policies of his rst term to continue over the next four years. Obama won major swing states, including Ohio, Florida, Colorado and Virginia. Obama gave a victory speech at his campaign headquarters in Chicago that political observers said harkened back to

the passionate speeches that helped him rst win the presidency in 2008. Americas never been about what can be done for us, Obama said. Its about what can be done by us together through the hard and frustrating, but necessary work of self-government. Thats the principle we were founded on. Obama claimed victory on Election Day after heading into campaign season in May by endorsing same-sex marriage during an TV interview with ABC News Robin Roberts, making him the rst sitting U.S. president to take that step. I have to tell you that over the course of several years as I have talked to friends and family and neighbors, when I think about members of my own staff who are in incredibly committed monogamous relationships, same-sex relationships ... at a certain point Ive just concluded that for me personally it is important for me to go ahead and afrm that I think same-sex couples should be able to get married, Obama said. In contrast, Romney said on the same

day that he opposes both same-sex marriage as well as civil unions offering the same benets as marriage. Obamas announcement, which followed Vice President Joseph Bidens support for same-sex marriage announced during an interview on NBCs Meet the Press, concluded the 19-month evolution that Obama started in November 2010 when he told progressive bloggers that he might eventually support marriage equality. Still, Obama said his endorsement was a personal one and that he was hesitant to address the issue previously because he didnt want to nationalize it. The president maintained states should be left to debate the issue because marriage hasnt traditionally been determined at the federal level. Following Obamas endorsement, a number of high-prole Democrats followed Obamas lead and made similar statements in favor of marriage equality such as House Democratic

Whip Steny Hoyer (D-Md.) and Assistant Minority Leader Jim Clyburn as well as celebrities, such as actor Will Smith and rapper Jay-Z. Because I believe that equal treatment is a central tenet of our nation, I believe that extending the denition of marriage to committed relationships between two people, irrespective of their sex, is the right thing to do and will not, in any way, undermine the institution of marriage so important to our society nor impose a threat to any individual marriage, Hoyer said. It will, however, extend the respect due to every one of our fellow citizens that we would want for ourselves and our children. The move was also positive in terms of nancing for the Obama campaign. According to an analysis from National Public Radio, donations to Obama nearly tripled in the immediate period after the announcement. The campaign took in nearly $9 million over three days, compared to $3.4 million in the three previous days.

Marriage victories in Maine, Md., Wash., Minn.


Marriage equality took a giant leap forward on Election Day when, for the rst time, voters in three states approved same-sex marriage rights at the ballot. In addition, voters in Minnesota rejected a ballot measure to ban same-sex marriage. The results brought the total number of states where same-sex marriage is legal to nine plus D.C. Same-sex marriage was made legal by referenda in Maryland, Maine and Washington State. The margin of victory in each state was slim; in Maryland, the measure passed with 52.4 percent of the vote. Evan Wolfson, president of Freedom to Marry, praised the wins after the results of the ballot initiatives were announced. Our huge, happy and historic wave of wins last night signaled irrefutable momentum for the freedom to marry, with voters joining courts, legislatures and the reelected president of the United States in moving the country toward the right side of history, Wolfson said. But those victories came just months after a defeat for LGBT advocates in May when North Carolina approved an amendment banning same-sex marriage. In the week prior to Election Day, the Obama campaign published a letter in each of three states where marriage

equality was on the ballot saying Obama supports the legalization of same-sex marriage in each of the states. While the president does not weigh in on every single ballot measure in every state, the president believes in treating everyone fairly and equally, with dignity and respect, said Michael Czin, Northeast regional press secretary for the Obama campaign, in the Portland Press Herald. The president believes same-sex couples should be treated equally and supports Question 1.

Baldwin elected rst openly gay senator


Senator-elect Tammy Baldwin made history on Election Day when she became the rst openly gay person to win election to the U.S. Senate. In a closely watched contest in Wisconsin, Baldwin, a Democrat, won election to the Senate in a race against Republican former Gov. Tommy Thompson. She won the election after serving nine terms in the U.S. House and being the rst non-incumbent openly gay person to win a congressional race. Following the announcement of her victory, Baldwin said shes well aware that I will be the rst openly gay member

of the United States Senate, but said she didnt run to make history. I ran to make a difference a difference in the lives of families struggling to nd work and pay the bills, a difference in the lives of students worried about debt and seniors worried about their retirement security, a difference in the lives veterans who fought for us and need someone ghting for them and their families when they return home from war, a difference in the lives of entrepreneurs trying to build a business and working people trying to build some economic security, Baldwin said. Attacks on Baldwins sexual orientation were virtually absent from the Wisconsin race, though Brian Nemoir, a Thompson campaign ofcial, circulated a video of her dancing at a gay Pride festival and told media outlets, Clearly, theres no one better positioned to talk heartland values than Tammy. The incident resulted in negative press for Thompson, who apologized for his aides action.

Record number of gay candidates win House seats


A record number of lesbian, gay and bisexual candidates were elected to the U.S. House this year, nearly doubling the number of out representatives serving in

the lower chamber of Congress. Gay Reps. Jared Polis (D-Colo.) and David Cicilline (D-R.I.) won re-election, and on the same night, out candidates Sean Patrick Maloney of New York, Kyrsten Sinema of Arizona, Mark Takano of California and Mark Pocan of Wisconsin won their races. The new additions minus Rep. Barney Frank (D-Mass.) and Tammy Baldwin (D-Wis.), who are leaving the U.S. House means LGB representation in the chamber will jump from four lawmakers to seven. Maloney, who will be the rst openly gay U.S. House member from New York, said upon the announcement that he won his bid to unseat Rep. Nan Hayworth (R-N.Y.) that voters in the states 18th congressional district voted for change. Across four counties on two sides of the Hudson River, in hundreds of schools, rehouses, community centers, in the Democratic vote of a quarter million of our neighbors, the people have settled this debate, Maloney said. They have closed this campaign. Sinema will become the rst openly bisexual member of Congress and Takano will become the rst openly gay person of color to have a House seat. Pocans election means Wisconsins 2nd congressional district will maintain gay representation as Baldwin heads to the U.S. Senate.

LGBT issues absent from presidential election


The presidential campaign season came to a close with virtually no reference to LGBT issues including the hotbutton issue of same-sex marriage in mainstream discourse between President Obama and Republican presidential nominee Mitt Romney. In each of the three presidential debates and the vice presidential debate, not a single reference to LGBT issues was made either by moderators or the participating candidates. There were some exceptions to this rule. In an Obama radio spot that aired close to Election Day on stations intended for younger listeners, a woman chides others who dont intend to go to the polls. What are you going to tell them, the woman asks. You were just too busy? You didnt think it mattered? Is that what youre going to tell your friends who cant get married? The ones who couldnt serve openly in the military? References to the LGBT community also came up numerous times during the Democratic National Convention, such as when Obama said the United States is a place where we dont think that government is the source of all our problems any more than are welfare recipients, or corporations, or unions, or immigrants, or gays, or any other group were told to blame for our troubles. Obama also touted Dont Ask, Dont Tell repeal in his campaign appearances in swing states.

DOMA, Prop 8 challenges advance in the courts


The Supreme Court set the stage this year for what might be the demise of Californias Proposition 8 and the Defense of Marriage Act when it agreed to take up litigation challenging the anti-gay measures. On Dec. 7, justices agreed to take up

Hollingsworth v. Perry, the lawsuit seeking to overturn Prop 8, and Windsor v. United States, a lawsuit led by 83-year-old New York lesbian Edith Windsor seeking to overturn DOMA. Ted Olson, one of the co-counsels representing plaintiffs, expressed optimism following the announcement that justices would rule against the Californias constitutional ban on samesex marriage, which was approved by voters in 2008. We have an exhaustive record on which to build this case, and it will be an education for the American people, Olson said. We are very condent the outcome of this case will be to support the rights of our gay and lesbian brothers and sisters. The case comes to the Supreme Court after the U.S. Ninth Circuit Court of Appeals in February ruled against Prop 8. Had the Supreme Court declined to accept the case, the ruling would have stood and marriage equality would have been restored to California. The DOMA case comes to the Supreme Court after numerous lower courts determined the anti-gay law was unconstitutional. The U.S. First Circuit Court of Appeals became the rst appellate court ever to strike down the

law and was followed by the U.S. Second Circuit Court of Appeals. This year alone, four federal district courts also ruled against DOMA.

EEOC issues landmark decision banning trans bias


The U.S. Equal Employment Opportunity Commission (EEOC) ruled in April that job discrimination against employees due to their gender identity is equivalent to sex discrimination under existing federal law. Transgender advocates joined legal experts in calling the ruling a historic development that provides transgender people in the public and private sector workforce with full coverage under Title VII of the U.S. Civil Rights Act of 1964. [W]e conclude that intentional discrimination against a transgender individual because the person is transgender is, by denition, discrimination based onsex, and such discrimination therefore violates Title VII, said the commission in its 5-0 ruling.

The decision was handed down as part of its resolution of a case led by the Transgender Law Center on behalf of Mia Macy, a transgender woman who charged that she was denied a job as a ballistics technician with the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives lab in Walnut Creek, Calif. Macy alleged that ATF ofcials were in the process of hiring her but claimed the job was no longer available due to budget cuts after she informed them she was transitioning from male to female. She learned later that ATF gave the job to someone else. Masen Davis, executive director of the Transgender Law Center, said it would be hard to overstate the signicance of the EEOC decision. Transgender people already face tremendous rates of discrimination and unemployment, Davis said. The decision today ensures that every transgender person in the United States will have legal recourse to employment discrimination and with it a way to safeguard their access to vital employment benets such as health insurance and retirement savings plans.

Chick-l-A, Boy Scouts assailed for anti-gay policies


Advocates in 2012 criticized a number of national business chains and organizations for their anti-LGBT policies. Activists organized protests outside Chick-l-A restaurants across the country after Dan Cathy, president of the Atlantabased fast food chain, spoke out against same-sex marriage during an interview. A University of Maryland-College Park student launched a petition to remove Chick-l-A from the campus food court, but some questioned the effectiveness of theoe efforts. Vandals targeted Chick-l-A restaurants in Frederick, Md., and in at least two other locations across the country in the weeks after Cathys controversial comments. Local and federal law ofcials said Floyd Lee Corkins, II, had 15 Chickl-A sandwiches in his backpack when he allegedly shot Family Research Council security guard Leo Johnson at the antigay groups downtown Washington headquarters in August. The Boy Scouts of Americas longstanding policy against openly gay scouts and scout leaders came under increased scrutiny in April after the organization ousted Jennifer Tyrrell as leader of her

sons troop in Ohio. The Boy Scouts of America Executive Board in July reafrmed the policy, but the organization has lost funding from a number of prominent organizations. These include the Merck and UPS Foundations.

Home HIV tests become available


The U.S. Food and Drug Administration approved for the rst time on July 3 an in-home, self-administered HIV test to be sold over the counter. Known as the OraQuick In-Home HIV test, the test was developed by OraSure Technologies, Inc. The test has the potential to identify large numbers of previously undiagnosed HIV infections, especially if used by those unlikely to use standard screening methods, the FDA said in a new release. Knowing your status is an important factor in the effort to prevent the spread of HIV, said Dr. Karen Midthun, director of the FDAs Center for Biologics Evaluation and Research. The availability of a homeuse HIV test kit provides another option for individuals to get tested so that they can seek medical care, if appropriate. The FDA says clinical studies of the test showed a 92 percent sensitivity rate, which means that of every 12 HIV-infected individuals tested with the kit, one negative result could be expected.

A positive result with this test does not mean that an individual is denitely infected with HIV, but rather that additional testing should be done in a medical setting to conrm the result, the FDA said. Similarly, a negative test result does not mean that an individual is denitely not infected with HIV, particularly when exposure may have been within the previous three months. FDA ofcials noted that the OraSure in-home test is the rst HIV test that allows users to learn their results at home immediately without interacting with a lab or medical professionals. The ofcials said the new tests potential for identifying large numbers of people who dont know they are infected outweighs concern by some that people who test positive should have immediate access to counseling and medical advice. Experts estimate that one-fth of the people infected with HIV are unaware of their status and often contribute to the infection of others.

Better late than never: Anderson Cooper comes out


A number of celebrities, politicians and other ofcials came out during 2012. CNN anchor Anderson Cooper publicly acknowledged being gay for the rst time

in a statement gay commentator Andrew Sullivan posted to his blog on July 2. Sam Champion, weather anchor for Good Morning America, announced on-air in October that he was engaged to his long-time partner, photographer Rubem Robierb. (The couple attended a Freedom to Marry fundraiser in Miami Beach, Fla., a few days later.) Gay singer Ricky Martin was among those who applauded Puerto Rican boxer Orlando Cruz after he came out on Oct. 3. R&B singer Frank Ocean in July acknowledged his homosexuality, while Jamaican singer Diana King came out on her Facebook page in June. British singer Mika told Instinct Magazine in August he is gay. Pennsylvania state Rep. Mike Fleck, a Republican who attended Liberty University in Lynchburg, Va., earlier this month came out during an interview with a local newspaper. Stephany Hoyer Hemmer, daughter of House Minority Whip Steny Hoyer (D-Md.,) came out as a lesbian during an exclusive interview with the Washington Blade in June. My father, as you know, just came out in support of gay marriage, she said. The momentum in Maryland right now for the adoption of the gay marriage law is fastpaced. Im 43 years of age, and Ive been gay my whole life and I just gured this is a good time to lend my name to the cause. DC Comics in June announced the Green Lantern is gay as part of its effort to reinvigorate the Earth 2 series.

From sodomy laws to marriage equality and beyond
many of the landmark achievements of the past four years would not have been possible. But the tide began to turn before Obamas arrival on the national political scene. And it began in 2003 with the Supreme Court decision in Lawrence v. Texas, which overturned sodomy laws in that state and 13 others, reversing a devastating 1986 ruling in Bowers v. Hardwick that upheld a similar law in Georgia. Justice Anthony Kennedy, still considered the courts swing vote, wrote the unforgettable majority opinion: The petitioners [Lawrence and Garner] are entitled to respect for their private lives. The State cannot demean their existence or control their destiny by making their private sexual conduct a crime. Finally, after decades of struggle, the mere fact of being gay could no longer be considered criminal. Kennedy noted that the Lawrence case does not involve whether the government must give formal recognition to any relationship that homosexual persons seek to enter. That, however, has nally changed as the high court this year agreed to hear two such cases on the Defense of Marriage Act and Californias Prop 8. In 10 short years, weve gone from ghting over private sex acts to impending Supreme Court rulings on marriage equality. That ruling helped to trigger a wave of fast-moving change. Just a year later, in 2004, Massachusetts became the rst state to legalize same-sex marriage. And the good news keeps coming. From Obamas victory in 2008 to Congress passing its rst LGBT rights bill an expansion of the federal hate crimes law to repeal of Dont Ask, Dont Tell. There have been so many highlights during my 10 years at the Blade, but one moment that has always stayed with me occurred in June 2009 at President Obamas rst Pride Month reception in the White House. Obama, anked by rst lady Michelle Obama, said, Welcome to your house. It was such a simple gesture, yet they were words that none of us had ever heard before. And the president and rst lady stayed to mingle, chat and pose for photos as a DJ spun Madonna tunes in the East Wing. A joyous and surreal moment after so many bleak years under Bush. It hasnt been all cocktails and dance divas, though. Ive edited and written countless stories over the past decade and two have haunted me. We proled a Baltimore gay couple in their 30s, both public school teachers. One was diagnosed with cancer and died within months. Hed been estranged from his family over his sexual orientation and had a will and other legal documents in place at his death. The family sued to have their sons body exhumed and moved to the family plot in Tennessee and they won. The surviving partner nally prevailed on appeal but lost everything in the process of an expensive legal battle to simply keep his partner in the ground. In another case, the Blade exposed the fact that four teens shot on a Newark, N.J., playground were gay. Three of them died. The mainstream media refused to report the basic fact that this was a hate crime motivated by the victims sexual orientation. Its been a whirlwind and unforgettable decade, from interviewing newsmakers and celebrities to chronicling historic civil rights advances to mourning crime victims to ghting with Bill OReilly over the evils of Scientology and outing closet cases like Shepard Smith. As we celebrate our 2012 Election Day victories, we look forward to a time when true equality comes to all 50 states and to countries around the world. Were not there yet and, so, keep reading.

It was December 2002. Sodomy laws remained on the books in 14 states. No state or jurisdiction in the country had yet legalized same-sex marriage (marriage equality was not a term in popular use). Congress had yet to pass a single piece of pro-gay legislation. The Democratic Party took gay money and votes but mostly paid lip service to our concerns. Barack Obama was a member of the Illinois state Senate. President George W. Bush was in his rst term and the country was still reeling from the terrorist attacks of 9/11. Bush would later make opposition to gay rights a cornerstone of his re-election campaign, pushing for ballot measures on marriage in key battleground states and even using his State of the Union address to call for a federal constitutional amendment banning recognition of our relationships. What a difference a decade makes. Ten years after joining the Blade, I have been privileged to occupy a front-row seat to some of the most signicant and historic events the movement has seen. Make no mistake that the election of Barack Obama marked the turning point in this quest for equality. Without his (erce) advocacy,

A look back at the year in local business


Entrepreneurs, enterprises score success, confront challenges
District residents didnt need a special designation to know that the city was rapidly renewing its notoriety as scandal capital of the country. A majority of D.C. Council members labored under suspicions of ethical lapses or criminal wrongdoing. The resignation and jailing of one Council member and the subsequent resignation and sentencing of the Council chairman reduced that percentage over time. However, news reports of new allegations and revelations of potential wrongdoing lost their shock value as the criminal became commonplace in local government. The citys elected leadership became even more of a hot nanny mess in the view of the business community. The legalization of same-sex marriage in Washington nearly three years ago continued to have far less economic impact than predicted. Fewer than expected have tied the knot, and the contribution to the local economy through ceremony and celebratory expenditures proved to be far less than that of heterosexual couples. Several local LGBT wedding consultants and service enterprises closed up shop. Many LGBT advocates across the country slid into a big ol pile of chicken-youknow-what by rushing to support ill-advised and illegal anti-business proposals by pandering politicians in a number of cities. They threatened to block entry or expansion of Chick-l-A retail outlets in their jurisdictions until sharper minds in local government legal ofces reeled them back in. The willingness of some in the gay community to promote proposed business bans based solely on the political opinions or contributions of corporate owners was startling. In the end, the asco merely created a controversy that eclipsed the intended focus and alienated some supporters of LGBT equality. The national restaurant chain saw sales soar. Special proles on two prominent local entrepreneurs, as well as other business owners, were featured. Urban Adventures Companies founder and owner David von Storch, proprietor of VIDA Fitness, Capitol City Brewing Company, 901 Restaurant and Lounge, Aural Spa and Bang Salon announced a new tness location planned for the rapidly developing Capitol Riverfront area. Level 2 Developments David Franco, also owner of Universal Gear and a major development inuence in the booming Logan-U Street area, detailed his long relationship with the city from early childhood to current contribution. The local business community reacted negatively to the announcement by the Districts healthcare exchange overlords that all small group plans would be forced into the system and prohibited from participating in the open market. This unpopular decision surprised many, as it broke a major promise by President Obama that those happy with their current health insurance coverage would be able to keep it. Fear of federal intervention became the trademark of the Districts plodding progress on implementing a medical marijuana program. Patients and advocates remain hopeful that at least a small program portion will become operational in the rst half of next year. Hanks Oyster Bar chef/proprietor Jamie Leeds again captured the spotlight as an illustration of all that is wrong with the Districts licensing of hospitality and nightlife businesses. Hours before the Pride Parade passed her establishment in the Dupont Circle area, the Gang of 5 license protest group battling the popular restaurant for seven years succeeded in forcing the closure of half of the outdoor dining area. The all-summer closure cost the business a small fortune in lost revenue until the restriction was again terminated. Neighborhood outrage over the regulatory incident helped lead the D.C. Council into taking some important rst steps last week to curtail the inuence of liquor-licensing objectors. Those were just a few of the topics discussed this year thanks for reading and all the best in the New Year ahead.

D.C. began 2012 as the yet-again winner of the ignoble annual distinction as worst in the nation among state jurisdictions for small business friendliness. Virginia remained best in the area, moving up into the top 10 most favorable enterprise environments, with Maryland again sinking lower toward the bottom. Both Maryland and the District continued to increase government expenditures and raised tax and fee burdens for both enterprise and residents. Each demonstrated a perplexing propensity for outdated taxand-spend tendencies and onerous business-choking overregulation. Some things never change.

2012 was a very good year


Obamas victory caps months of advances for LGBT rights
caucus results were and I am still wondering. That was about the same time the pizza guy amed out over his transgressions with a series of women. The ups and downs of the Republican debates were fascinating in a macabre way, like watching a train wreck is fascinating. Some of the candidates faded faster than others including Tim Pawlenty, Michele Bachmann (not fast enough), Jon Huntsman and Rick Perry. Others like Newt Gingrich and Rick Santorum hung around longer and used the eventual nominee Mitt Romney as a piata dragging him further to the right all to the eventual benet of President Obama. Then there was Foundry United Methodist Churchs ght for LGBT rights within the Methodist Church. While they lost that ght we can all be thankful for the ongoing work of Foundry and their Senior Pastor Dean Snyder. In May, Dr. Robert Spitzer, a leading member of the American Psychological Association, wrote an apology (better late than never) that admitted he was wrong when he authored a study supporting reparative therapy for gays. That study harmed unknown numbers of young gay men who were subjected to this phony therapy and still are in some areas. June brought Pride with its festivals and parades and the knowledge that we now had a president who supported marriage equality and was willing to stand up and tell the world. There was also the decision by the Supreme Court to declare Obamacare constitutional. In his statements on the Affordable Care Act as well as other comments Justice Scalia again showed why he should be impeached. July brought the International AIDS Conference to the United States for the rst time in 20 years. There were meetings and talk about how far we have come in the ght against HIV/ AIDS and recognition of how far we still had to go. There was the announcement of the rst patient, called the Berlin Patient who has reportedly been cured and the discussion of spending more money on nding a cure and not just nding a vaccine. Secretary of State Hillary Clinton addressed the conference and to great applause spoke of a generation without AIDS being within reach. In August we watched the spectacle of the Republican Convention in which they approved a platform clearly more appropriate for the 19th century than the 21st. They highlighted their ght against women and the LGBT community and selected the Romney/Ryan ticket, which proved a colossal mistake. The election was going ne for the Democrats until the rst presidential debate, when President Obama barely showed up. An election thought to be in the bag suddenly became a nail biter for a short while. But those of us who are Nate Silver fans soon understood that President Obama was going to win a second term and do so fairly easily. The bonus was winning marriage referenda in four states and gaining House seats and two Senate seats as well. All in all, a good year yet it ended with so many things left to be done. Some are easy and can be done with the stroke of a pen like the president signing an executive order to ban discrimination in federal contracting. Others like setting the nation on a course to scal solvency will take negotiation and perseverance and require our help as we pressure Congress to act. But at midnight on Dec. 31, as we say goodbye to 2012 and welcome in 2013, let us all drink a toast to the year past and say a prayer and pledge to each other that in the year to come we will keep up the good ght for equality and will do everything in our power to make the world a safer and healthier place for all.

Jewish Film Festival features gay content

Ive had many affairs of the heart, but at the end of the year I always think back on my affairs of the hearth: my real estate relationships with buyers and sellers. The purchase of a home is probably one of the largest and most important business affairs you will ever be involved in. Its an emotionally charged process, where you share the intimate details of your life your wants, needs, nances and insecurities with relative strangers. Your own story may be a romantic comedy, a farce or a thriller with lots of twists and turns, but each time you buy or sell a home, you can be sure it will be An Affair to Remember.

The Meet Cute


Selecting your agent is the rst step in beginning your affair with real estate. You may spy him across a crowded room at an open house or be attracted to his online photo. You may be introduced to her by friends or family, or share a smile in the checkout line at Whole Foods. However you meet, your relationship begins with a hint of desire.
